<div>
	So I've had a letter from my bank regarding a balance transfer credit card (0% interest for 12 months).
</div>

<div>
	I figured great i can get rid of my credit card debt for the most part in 1 here making the same payments. Not so much...
</div>

<div>

</div>

<div>
	I am disabled and receipt of disability benefits.
</div>

<div>
	I get universal credit with the unable to work element.
</div>

<div>
	I then get personal independence paid separately.
</div>

<div>
	I have provided bank statements and universal credit statements that clearly reflect what I have stated.
</div>

<div>

</div>

<div>
	Natwest simply aren't understanding what's in front of them.
</div>

<div>
	They keep saying they can't verify figures I've given but they can, it's all there.
</div>

<div>

</div>

<div>
	This is financially detrimental to me as I am now missing out on their 0% balance transfer for 13 months which will personally cost me £456 in interest on my current card. The lack of understanding of a financial statement here is concerning.
</div>

<div>

</div>

<div>
	Figures as follows (note these aren't the exact figures, i did give the bank exact figures to the penny):
</div>

<div>

</div>

<div>
	Universal credit:
</div>

<div>

</div>

<div>
	Total entitlement- 1,282.27
</div>

<div>
	Direct rent deduction- 458.86
</div>

<div>
	Total paid AFTER RENT deduction 823.41
</div>

<div>

</div>

<div>
	Personal independence is then paid every 4 weeks direct to my bank away from universal credit of 412.40
</div>

<div>

</div>

<div>
	Total entitlement monthly BEFORE rent deduction 1694.67
</div>

<div>

</div>

<div>
	Total AFTER RENT reduction 1235.81
</div>

<div>

</div>

<div>
	Broken down- 823.41 from universal credit
</div>

<div>

</div>

<div>
	Plus 412.40 from personal independence payment
</div>

<div>

</div>

<div>
	My bank statements and universal credit statement provide the breakdown and confirm figures provided to the penny.
</div>

<div>
	They just aren't understanding what they're looking at.
</div>

<div>

</div>

<div>
	I even created individual transaction pdfs from my banking app (literally batwest) to show whats landed in my bank.
</div>

<div>
	Unsurprising I worked over in the call centre for a while and well....yep
</div>

<div>

</div>

<div>
	If I do the application and include figures AFTER the rent deduction their own system then asks for my rent figure.
</div>

<div>
	When I do this it essentially takes my rent off twice and says no longer eligible.
</div>

<div>
	Which just simply isn't correct.
</div>

<div>
	I can't put in £0 for my rent as again this simply wouldn't be correct.
</div>

<div>

</div>

<div>
	I spoke to one on the live chat and he says
</div>

<div>
	" we can't confirm the figures you've proved. You can they're all on the uc statement Your simply not understanding what your looking at.
</div>

<div>
	Your net and gross don't match up.
</div>

<div>
	It's universal credit not paye that doesn't apply..."
</div>

<div>

</div>

<div>
	I explained it once again and stated its the direct rent reduction throwing you off again thats not paye it's different.  round and round...
</div>

<div>

</div>

<div>
	Then I have today received a phone call from the guy I spoke to in live chat.
</div>

<div>
	Exact same conversation, again. "can't confirm figures".
</div>

<div>
	You can, it's all there on the universal credit statement.
</div>

<div>
	You are simply failing to understand what's in front of you. It's ludicrous."
</div>

<div>

</div>

<div>
	I have since been declined as "unable to confirm figures" which again just isn't correct.
</div>

<div>

</div>

<div>
	Completely baffled by it
</div>

<div>

</div>

<div>
	What can I do here ?
</div>

<p>
	Hi,
</p>

<p>
	I am supporting my elderly mother with what I believe to be irresponsible lending.
</p>

<p>
	We have discovered that in 2023 she applied for a natwest credit card.
</p>

<p>
	At this point she was not managing her existing debts well however we didn't know this at the time.
</p>

<p>
	She applied on line but said that there was an error.
</p>

<p>
	She tried again later in the day and it worked.....a week later 2 cards arrived.
</p>

<p>
	the cards are identical - same product, same credit limit but 2 separate accounts.
</p>

<p>
	At this point in her life she was dealing with my dad's ill health - he passed away 6 months later, and was too proud to ask for help.
</p>

<p>
	She used the cards to plug the gap however this has led to her into a bad situation with 19K of credit card debt.
</p>

<p>
	I think that it was irresponsible of Natwest to allow a pensioner to take out 2 cards on the same day
</p>

<p>
	- especially as she was already in quite a lot of debt that wasn't being particularly well managed.
</p>

<p>
	Is this an example of irresponsible lending??
</p>

<p>
	Hi,
</p>

<p>
	I <a href="http://www.consumeractiongroup.co.uk/forum/showthread.php?426126-CONC-7.9-Contact-with-customers-including-visits&amp;p=4548976#post4548976" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=22&amp;alias=received%20a%20letter" class="keywordUrl">received a letter</a> from ACI today regarding an old overdraft debt which is currently owned by Intrum.
</p>

<p>
	Normally I <a href="https://www.consumeractiongroup.co.uk/topic/422044-why-you-should-not-ignore-a-private-parking-ticket/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=85&amp;alias=ignore" class="keywordUrl">ignore</a> such letters, but ACI are litigious beasts and TM Legal have sued me (and lost) in the past.
</p>

<p>
	Looking around the forums it seems like they're busy throwing around court claims like confetti again.<br>
	<br>
	They have not yet threatened legal proceedings.
</p>

<p>
	this matter concerns an overdraft that was opened in 2005.
</p>

<p>
	No payment has been made, or contact had with the creditor, or any of the subsequent debt owners since 2014.
</p>

<p>
	It does not appear on my <a href="https://www.consumeractiongroup.co.uk/forum/140-credit-reference-agencies/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=21&amp;alias=credit%20file" class="keywordUrl">credit file</a>.
</p>

<p>
	It is without a doubt <a href="https://nationalconsumerservice.co.uk/keywords/view/47-statute-barred/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=47&amp;alias=statute%20barred" data-ipshover-width="400" class="keyword">statute barred</a>.
</p>

<p>
	ACI could produce no evidence of the previous debt they sued me for, but that didn't stop them from trying.
</p>

<p>
	I don't think the fact this debt is DB will deter them.<br>
	<br>
	What's my best strategy here?
</p>

<p>
	<a href="https://www.consumeractiongroup.co.uk/topic/422044-why-you-should-not-ignore-a-private-parking-ticket/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=85&amp;alias=ignore" class="keywordUrl">Ignore</a> it?
</p>

<p>
	Write to them?<br>
	<br>
	My biggest worry here is that I have a 3 month trip abroad planned early next year, and don't want a CCJ being awarded if a court date ends up being set while I'm out of the country and can't attend.
</p>

<p>
	[Edit]
</p>

<p>
	A few years ago the original lender sent me several cheques for compensation due to charges an internal review had deemed unfair.
</p>

<p>
	I cashed those cheques.
</p>

<p>
	Would that have reset the clock on it being <a href="https://nationalconsumerservice.co.uk/keywords/view/47-statute-barred/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=47&amp;alias=statute%20barred" data-ipshover-width="400" class="keyword">statute barred</a>?
</p>

<p>
	To be clear: I have not made any payments towards the debt, or admitted it.
</p>

<p>
	Hi,
</p>

<p>
	My business is now going through insolvency and I have an outstanding NatWest business loan of around £20,000 with a personal guarantee to me.
</p>

<p>
	The insolvency people will be contacting the bank now to freeze accounts as part of what they need to do.
</p>

<p>
	The bank has not yet contacted me and all payments have been up to date.
</p>

<p>
	I do have a small amount of personal savings but I was wondering what the best steps of action are here for me.
</p>

<p>
	Luckily most of my creditors had been paid.
</p>

<p>
	However, I also have an outstanding business loan to the Funding Circle of around £40,000 with a personal guarantee to me
</p>

<p>
	Funding Circle have not yet contacted me and all payments have been up to date.
</p>

<p>
	My insolvency agent is in the process of contacting creditors now.
</p>

<p>
	I do have a small amount of personal savings but I was wondering what the best steps of action are here for me.
</p>

<p>
	Thanks for your help.

<p>
	<u><strong>NATWEST BANK </strong></u>
</p>

<p>
	whom I had been an exceptional loyal customer
</p>

<p>
	having a house with the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> product, home insurance, unit trusts, ISA’s, and also have the business account as well as their charge card, spending thousand pounds on it
</p>

<p>
	i had all my accounts closed as they had not organised my remortgage with them in the time allowed.
</p>

<p>
	In fact I had done the night before online and spoke to <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> department on the phone the next day (deadline day)
</p>

<p>
	he told me he could see everything have been arranged online and the payment was made which I still have proof of.
</p>

<p>
	At the weekend I found none of my cards were tonight they had no money and it took me three weeks to work out that I could get a bank account.
</p>

<p>
	I just walking into a bank and I’ve ever since had the cash account by Coop.
</p>

<p>
	In the meantime I submitted the complaint which of course they never addressed the specific question of where the phone call went,
</p>

<p>
	what about the Everton of having paid the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> and why have they closed all three accounts abs, any money that was in the current business account.
</p>

<p>
	I was not in arrears with the charge card and in fact clear the £15k overdraft within three months.
</p>

<p>
	Unfortunately, all of these events meant that my business crumbled and my mental health was severely affected such that I didn’t really address the issues of related to my complaint of Closing all my accounts based on failing to complete the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> deal, which was my word against theirs, i Recorded the payment made and my online submission yet somehow this is disappeared and not appeared in the subject access request I made five years later.
</p>

<p>
	It took over a year for the bank to produce my subject access request and when I did complain to the information commissioner he asked me what I wanted to do which is a rather strange question as I thought given that it was such a long time that they were in breach of their obligation to provide me with details.
</p>

<p>
	In the meantime,  they still proceeded to attempt repossession order on my house.
</p>

<p>
	I explained that it was illegal to file a notice of repossession when the account was in dispute, yet their accountants and their lawyers seem to <a href="https://www.consumeractiongroup.co.uk/topic/422044-why-you-should-not-ignore-a-private-parking-ticket/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=85&amp;alias=ignore" class="keywordUrl">ignore</a> his fact as did the judge who <a href="https://www.consumeractiongroup.co.uk/topic/422044-why-you-should-not-ignore-a-private-parking-ticket/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=85&amp;alias=ignored" class="keywordUrl">ignored</a> my letter stating that I wasn’t attending unlawful hearing and asked him to throw the case out which he didn’t
</p>

<p>
	Unless I managed to keep the house <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> on time and eventually they were forced to offer me a <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> and I almost completed payments
</p>

<p>
	on that reason I am writing is because I have sent another complaint stating that none of the documents that i held for that era was there any reference to the money they absorbed from my current/business account for the purposes that they say they’re entitled to form of payment towards the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage%20arrears" class="keywordUrl">mortgage arrears</a>.
</p>

<p>
	Listed is a £1000 charge for legal fees which I’m disputing, another £995 for product failure (no idea what that’s about), additional £35 charges for seven months during which time I was in fact paying the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> monthly but there was claiming that it was still in arrears which I know to be irregular, as well as unlawful as I was classified as a vulnerable person. At no point did NatWest follow the lenders code.
</p>

<p>
	They made it very difficult to balance my accounts when I had no account to cash cheques in, they blocked my online access to my accounts so I couldn’t see which invoices were paid and owed and if there were any direct debits I needed to address.
</p>

<p>
	Its now been three months since I submitted a complaint to the NatWest bank asking for details around the above points and I repeatedly get emails and text messages stating that they apologise it’s taken so long to get to the bottom of my complaint and leave a statement that they hope to resolve it soon.
</p>

<p>
	I don’t think this is good enough, and what I could do to push the matter along as I don’t feel they’ve ever dealt with any of my complaints satisfactory always focusing on what I did wrong which never relates to the matter in hand.
</p>

<p>
	Thanking you in advance for your advice
</p>

<p>
	Hi All,
</p>

<p>
	brief outline.
</p>

<p>
	I have Natwest CC debt £8k last payment i made was 7th November 2018 Not a penny since.
</p>

<p>
	coming up to the 6 year mark.
</p>

<p>
	Can't remember when i took out the credit card would be a few years before everything hit the fan.
</p>

<p>
	Moved house 2020 - updated NatWest as I still have a current account with them.
</p>

<p>
	Then Lowells took over from Moorcroft and were writing to me at my current address.
</p>

<p>
	I did get a family member to speak to them 3 years ago regarding the debt explained although it may be in my name I didn't rack it up then went contact again.
</p>

<p>
	29th may received an email from overdales saying they were now managing the debt.
</p>

<p>
	I have not had any letter yet which i thought is odd?
</p>

<p>
	Couple of questions
</p>

<p>
	1. Does my family member speaking to lowell restart <a href="https://nationalconsumerservice.co.uk/keywords/view/47-statute-barred/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=47&amp;alias=statute%20barred" data-ipshover-width="400" class="keyword">statute barred</a> clock?
</p>

<p>
	2. Do you think Overdales aren't writing to me because they will bac door CCJ to old address even though Lowells have contacted me at current address never at previous?
</p>

<p>
	( have no proof though stupidly binned all letters <span><img alt=":-(" data-emoticon="" height="15" src="https://media.invisioncic.com/h334558/emoticons/sad.gif.7243bbb3aa1ccd941c47ad9299f55bcd.gif" title=":-(" width="15"> )</span>
</p>

<p>
	Should I write to them and confirm my address just incase?
</p>

<p>
	Does this restart <a href="https://nationalconsumerservice.co.uk/keywords/view/47-statute-barred/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=47&amp;alias=statute%20barred" data-ipshover-width="400" class="keyword">statute barred</a> clock?
</p>

<p>
	3. what do you think best course of action is?
</p>

<p>
	Any help/advice is appreciated
</p>

<p>
	I am aware they may ramp up the process now due to 7th December being the 6 year mark.
</p>

<p>
	Many Thanks in advance!
</p>

<p>
	The threads on here have been super helpful to read.

<p>
	Hi,
</p>

<p>
	I owe Natwest 12K for a loan that has just defaulted.
</p>

<p>
	The debt has just been passed to Zinc to collect on Natwest’s behalf.
</p>

<p>
	I obtained the loan in 2020 I suspect that Natwest will have the credit agreement.
</p>

<p>
	I am currently unemployed and likely to stay that way for a while.
</p>

<p>
	I have no assets/property/savings.
</p>

<p>
	I was thinking of paying £1 PCM for a couple of years to give them time to lose the paperwork, but am aware this would keep resetting the SB clock.
</p>

<p>
	What do you recommend?
</p>

<p>
	What would be Natwest’s likely course of action if I stopped making any payments?
</p>

<p>
	Interestingly, someone at NatWest told me they would probably write it off after 3-4 years and that they rarely sell debt on these days.
</p>

<p>
	Seemed genuine.
</p>

<p>
	Do you agree with these statements?
</p>

<p>
	Thanks in advance for any help.

<p>
	I recently visited Rome and wanted to purchase some paintings from a dealer who was the third generation in his family to continue the fine art business where he worked.
</p>

<p>
	The business is a legitimate business
</p>

<p>
	but as it is in Italy the dealer could not accept a cash deposit and did not accept credit cards and suggested I do a bank transfer when I got home to secure the paintings until the export license came through.
</p>

<p>
	Natwest has been utterly obstructive and has point blankly refused to let me pay .
</p>

<p>
	The money is not theirs to dictate how I spend it ,
</p>

<p>
	this is absolutely disgusting.
</p>

<p>
	I wondered if anyone else had problems with this useless bank .

<p>
	I seem to have gotten into a spot of bother with Natwest.
</p>

<p>
	In August I moved house and contacted NatWest to have my address updated.
</p>

<p>
	I asked for all the accounts I had to be updated which the person on the phone advised she would do.
</p>

<p>
	My credit card was due to expire in Novbember, i called them and chased them to see where the card was.
</p>

<p>
	I was told they didn't update the address on my credit card, the person claimed to do it and then said she had ordered a new card.
</p>

<p>
	A week later I called to ask where is my new card to find out the lady never updated my address or re-issued my card.
</p>

<p>
	I was then told they were unable to re-issue my card due to their lending policy, debt on the card is around £6k and I have been making payments to the card via <a href="http://www.directdebit.co.uk/DIRECTDEBITEXPLAINED/Pages/DirectDebitGuarantee.aspx" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=25&amp;alias=direct%20debit" class="keywordUrl">direct debit</a>.
</p>

<p>
	I was a bit surprised at this as it came out of the blue.
</p>

<p>
	They said they will continue to take payments from me via <a href="http://www.directdebit.co.uk/DIRECTDEBITEXPLAINED/Pages/DirectDebitGuarantee.aspx" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=25&amp;alias=direct%20debit" class="keywordUrl">direct debit</a> and offered £50 compensation credited to the credit card account.
</p>

<p>
	I made a complaint to them about this but I got the same response and £80 credit to my account.
</p>

<p>
	They said they would just leave the account as it is
</p>

<p>
	I am worried this is going to mess my credit score up.
</p>

<p>
	Any advise would be appreciated.
</p>

<p>Hello Everyone!</p>
<p>
I had a Natwest Mastercard account, which was defaulted in 2006. </p>
<p>
I have been paying off monthly sums direct to Natwest every month since, </p>
<p>
no <a href="https://nationalconsumerservice.co.uk/keywords/view/78-ppi-misselling/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=78&amp;alias=ppi" data-ipshover-width="400" class="keyword">PPI</a> and interest not being added. </p>
<p>
Late payment and overlimit fees of £175.00 unclaimed to date. </p>
<p>
Account balance approx £8K</p>
<p> </p>
<p>
The account has <span style="text-decoration:underline">never ever</span> been shown on any <a href="https://www.consumeractiongroup.co.uk/forum/332-the-consumer-rights-act-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=17&amp;alias=cra" class="keywordUrl">CRA</a> reports, even before defaulted.</p>
<p> </p>
<p>
Natwest have now advised that they have now "partnered" with Wescot Credit Services, </p>
<p>
who will now "manage" the remainder of the repayment plan, </p>
<p>
and that I should continue to maintain payments direct to Natwest.</p>
<p> </p>
<p>
In view of this, I made a <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a> under section 78 (1). </p>
<p> </p>
<p>
Their response to my <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a> was, </p>
<p>
as the account was opened prior to 19th May 1985, </p>
<p>
that the <a href="https://www.fca.org.uk/news/press-releases/agenda-priorities-consumer-credit" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=83&amp;alias=consumer%20credit" class="keywordUrl">Consumer Credit</a> (Cancellation Notices and Copies of Documents) Regulations 1983 applies to the account,</p>
<p>
 and it is therefore sufficient for them to send me a copy of their current terms as a "true copy", </p>
<p>
and therefore the agreement is enforceable. </p>
<p> </p>
<p>
The copy that they provided is headed "Credit Card Agreement regulated by the <a href="https://www.fca.org.uk/news/press-releases/agenda-priorities-consumer-credit" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=83&amp;alias=consumer%20credit" class="keywordUrl">Consumer Credit</a> Act 1974,</p>
<p>
 and is on the reverse of a "Replacement credit card" letter, addressed to me at my current address,</p>
<p>
 not at the address where I lived at when the account was opened.</p>
<p> </p>
<p>
Are they correct in their view that the agreement is enforceable? </p>
<p> </p>
<p>
As usual all comments welcome.</p>
<p>
Thanks</p>

<p>
	I hope this is in the right place.
</p>

<p>
	My Auntie is 74 years old and is recovering from major surgery.
</p>

<p>
	Although she is not stupid, she has done a stupid thing.
</p>

<p>
	She received a phone call (mobile) from a nice sounding chap who was trying to get her to buy Bitcoin guaranteeing a profit. He phoned every day and gained her trust.
</p>

<p>
	She eventually parted with £250, but within 2 days he rang her back and told her that her investment had more than doubled. He got her to download Anydesk to her phone, and he took it from there. He put £650 in her account and she was really happy.
</p>

<p>
	He persuaded her to reinvest, but to leave the money in the account and he will do the rest.
</p>

<p>
	To cut a long story short, he has taken out 4 large separate loans in her name from sainsbury's, mbna, zopa and nuvuna totalling £70,000.
</p>

<p>
	The minute the funds for the loans were in her account he transferred them out to somewhere else. She now stands to lose her house because of it.
</p>

<p>
	She banks with Natwest, but they are not interested at the moment. She also contacted <a href="http://www.actionfraud.police.uk/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=4&amp;alias=action%20fraud" class="keywordUrl">Action Fraud</a> and the Police and they say they can't help.
</p>

<p>
	Is there anything else she can do?
</p>

<p>
	She lives alone, and after surgery had to rehome her beloved pet, so she was in a very vulnerable situation.
</p>

<p>
	I can't believe she fell for this, but I promised her I would help as best I can, and the people on here have been a massive help in the past.
</p>

<p>
	Thank You.

<p>
	Admins: There maybe an old thread on here about this debt on old Visa card.
</p>

<p>
	I have been paying a monthly nominal sum to natwest since 2008 approx.
</p>

<p>
	I have moved, advised Natwest of my new address and also made a <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a> to Natwest.
</p>

<p>
	I have been getting monthly statements from them, the debt has not been sold on! I have now stopped paying pending their response if any.
</p>

<p>
	I sent the <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a> to them on 19th September 2023, with a £1 PO duly endorsed on the back "only to be used for <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a>", I used the wording as suggested on here.
</p>

<p>
	Today I received a statement, sent to my old address, redirected by Royal Mail to my new address. Statement dated 28th September. It shows the £1 payment made as a deduction from the debt.
</p>

<p>
	Any thoughts or advice as to how to proceed: do nothing until the <a href="https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=98&amp;alias=cca%20request" class="keywordUrl">CCA request</a> is responded to?,
</p>

<p>
	remind them of the notation on the reverse of the PO?,
</p>

<p>
	remind them of my change of address?
</p>

<p>
	Thanks for reading
</p>

<p>
	After 30 years of custom Natwest's draconian actions taken against me and sometimes unlawfully, for defaulting on my <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> back in 2015 severely compromised my financial status, and my mental health.
</p>

<p>
	They claimed that I failed to arrange a new <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> product which wasnt true and after removing any online access to my accounts which were not in the red, they closed my current and business account and stopped my charge card. In fact when I called the customer helpline the day after I realised this had been done, there was no record of my existence.
</p>

<p>
	Despite the account being in dispute and a <a href="https://www.consumeractiongroup.co.uk/topic/332398-full-subject-access-request-under-the-new-gdpr-2018-regime/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=3&amp;alias=sar" class="keywordUrl">SAR</a> requested in January 2016 but not receiving any documents until Jan 2017 NATWEST filed for repossession and was granted permission to do so. However, I turned my circumstances around and with financial help from family I had in fact <a href="http://www.consumeractiongroup.co.uk/forum/legalities/2763-estoppel.html" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=39&amp;alias=overpaid" class="keywordUrl">overpaid</a> by the end of that financial year by £7400.
</p>

<p>
	No further defaults occurred and a new <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> deal was offered that would be for the amount outstanding on the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> plus the arrears. It wasnt made clear that there were 7 months of late payment fees of £35,  litigation fees for £1036, arrangement failure charged at £995 for which I am awaiting an explanation for as no such failure occurred. There is also the sum of all the money that was in both my current and business account missing from the annual statements which they claimed to have put towards the <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> when they closed my accounts.
</p>

<p>
	I had suffered from severe mental health issues thereafter hence why these issues are being raised now but they were highlighted when I tried to make sense of a persistently very low credit rating ever since the first default in 2015.
</p>

<p>
	To my amazement Transunion reported that derogatory remarks have been and may well continue to be  submitted by NATWEST regarding defaults on my <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a>. These dont relate to 2015 but to a period starting July 2017 thru to January 2019. Annual <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> statements from Natwest as well as my current account statements show payments were made in that period.
</p>

<p>
	I reported the matter to NATWEST 2 weeks ago and after 4 phone calls I received an acknowledgment of my filed complaint only yesterday. I have spoken to people from Financial support, the credit assessment team have been notified and now its in the hands of the complaints department. I am told this is a very peculiar case and every effort is being made to find the 'missing' money.
</p>

<p>
	I have read your guidance on credit ratings in relation to banks reporting but other than filing a written complaint to NATWEST as my phone calls seem to be <a href="https://www.consumeractiongroup.co.uk/topic/422044-why-you-should-not-ignore-a-private-parking-ticket/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=85&amp;alias=ignored" class="keywordUrl">ignored</a> and another to Transunion, is there anything else I should be thinking of and what kind of redress should i be asking for?

<p>
	Hi everyone
</p>

<p>
	I need some advise from anyone willing to offer and from a relatives experience and high recommendations I think I will certainly get this here <img src="https://cdn.jsdelivr.net/gh/twitter/twemoji@14.0.2/assets/72x72/1f600.png" class="ipsEmoji" alt="😀">
</p>

<p>

</p>

<p>
	Here goes,
</p>

<p>

</p>

<p>
	I have had a current account with Natwest for 10years or more and when i got into financial difficulties I applied for an overdraft around 6 years ago.
</p>

<p>

</p>

<p>
	I could not believe how easy it was and cut a long story short my debt problem continued to spiral, over a few months before i knew it i had continual overdraft increase requests accepted and i now had an overdraft £4000,
</p>

<p>

</p>

<p>
	So for the last 6 years I have just been paying the interest fees on the account which has continually been overdrawn just to try and keep it from exceeding the limit and incurring charges which some months further down the line failed to do and paid the overdraft charges when i could.
</p>

<p>

</p>

<p>
	Over the last 2 months Natwest have been contacting me to settle the overdraft in full which i have not been able to do then suddenly the account was closed and I can not get access with online banking and now they say i have to deal with a <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a>  (Moroncroft <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=debt%20collection" class="keywordUrl">debt collection</a>) who are now sending me threatening letters.
</p>

<p>

</p>

<p>
	I don't dispute the overdraft debt but i need advice how to go about settling the overdraft and have a few questions?
</p>

<p>

</p>

<p>
	1, I assume that even if the account is in default and Moroncroft have been assigned the debt i should still communicate with Natwest
</p>

<p>

</p>

<p>
	2, I would like to get this debt cleared but i assume there will be plenty of charges on the account and wonder if i can claim them back and would like to know how as I have been told that unfair bank charges can be claimed?
</p>

<p>

</p>

<p>
	3, can i ask Natwest to adjust the account and remove all unfair charges and then have a final amended figure to settle the account and clear the debt
</p>

<p>

</p>

<p>
	Any help will be very much appreciated.
</p>

<p>

</p>

<p>
	Thanks owed

<p>
	Hi,
</p>

<p>

</p>

<p>
	I just wanted to get some advice.
</p>

<p>

</p>

<p>
	I took out a student account with Natwest around 2008 and at the time I was offered an overdraft of £1500. Around 2009 I defaulted on the account and I never paid back the overdraft.
</p>

<p>

</p>

<p>
	Its been over 10 years since I defaulted and within this time i have not had any communication from Natwest to chase the debt not even a letter. I am more curious than anything whether this would have any impact on me in the future if I applied for a Natwest <a href="https://www.handbook.fca.org.uk/handbook/MCOB/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=93&amp;alias=mortgage" class="keywordUrl">mortgage</a> for example?
</p>

<p>

</p>

<p>
	I tried to do an eligibility check for a Natwest credit card and half way through it recognised thar I have account with them and requested I enter account details to proceed. How long do Natwest hold details for? Is it worth paying the debt to avoid future problems?
</p>

<p>
	Hi all,
</p>

<p>
	I got a loan in 2015 for the sum of around £10,000
</p>

<p>
	a year later I lost my job and everything started to fall apart.
</p>

<p>

</p>

<p>
	I was already struggling with depression etc and this just made it worse.
</p>

<p>

</p>

<p>
	I obviously couldn’t keep up with the repayments and in November 2016 was the first payment I missed from here a default was registered on 31 January 2017 to be honest I went on and eventually forgot about this as I never heard anything from them.
</p>

<p>

</p>

<p>
	Then around 2 years ago I <a href="http://www.consumeractiongroup.co.uk/forum/showthread.php?426126-CONC-7.9-Contact-with-customers-including-visits&amp;p=4548976#post4548976" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=22&amp;alias=received%20a%20letter" class="keywordUrl">received a letter</a> issuing an apology as they are meant to send something out every so often which they didn’t do. I can’t remember what this was.
</p>

<p>

</p>

<p>
	fast forward to now, the debt has gone from my <a href="https://www.consumeractiongroup.co.uk/forum/140-credit-reference-agencies/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=21&amp;alias=credit%20file" class="keywordUrl">credit file</a> and I’ve still not heard anything from the bank.
</p>

<p>

</p>

<p>
	Is this now <a href="https://nationalconsumerservice.co.uk/keywords/view/47-statute-barred/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=47&amp;alias=statute%20barred" data-ipshover-width="400" class="keyword">statute barred</a> or can this bite me back. <br>

</p>

<p>
	thanks for any help or advice in advance

</p>

<p>

</p>

<p>
	Before contacting the <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a> I need some advice on the best approach.

</p>

<p>

<p>
	At the time I was unable to take them up on their generous offer, however, six months on I wrote to the <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a> and made an offer of settlement at 50% of the outstanding balance.

<p>
	This, as I had expected, was “rejected by our client. But please call us immediately so we can discuss this matter further.”
</p>

<p>

</p>

<p>
	I instead wrote again asking what would be an acceptable figure their client would accept.
</p>

<p>

</p>

<p>
	The <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a>'s reply: “please ring us urgently so we can discuss this matter further. - please complete these before calling so you can provide us with this information.
</p>

<p>

</p>

<p>
	We also require you to confirm the source of the funds you intend to use to pay off this debt”.
</p>

<p>

</p>

<p>
	At that point, I decided not to proceed further and wrote to the <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a> informing them I would continue making the monthly payments.
</p>

<p>

</p>

<p>
	Now, a year later, I have decided to try again. Before contacting the <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a> I hope someone on this site may be able to advise on the best approach.
</p>

<p>

</p>

<p>
	Is it normal/required that you confirm the source of the funds?
</p>

<p>

</p>

<p>
	Is it the original creditor that whats to know this, or is just the <a href="http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?405-Debt-Collection" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=24&amp;alias=dca" class="keywordUrl">DCA</a>?
</p>

<p>

</p>

<p>
	How is the source of the funds relevant - or are they seeing how much more they can squeeze out of me?
</p>

<p>

</p>

<p>
	Any advice would be appreciated.

<p>
	Hi, I am in dispute with my bank, I have raised a complaint with the Financial <a href="http://www.consumeractiongroup.co.uk/forum/bank-charges-finance-industry/234186-financial-ombudsman-comes-under.html#post2594577" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=52&amp;alias=ombudsman" class="keywordUrl">Ombudsman</a> but they have rejected my complaint.
</p>

<p>

</p>

<p>
	I realise that it is easy to become very polarised when you are dealing with a dispute in person so I wonder if anyone could give their own impartial view.
</p>

<p>

</p>

<p>
	I am a self employed plumber, most of my work is domestic and most of my customers <a href="https://www.consumeractiongroup.co.uk/announcement/32-are-you-going-to-pay-for-your-second-hand-car-with-a-bank-transfer/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=132&amp;alias=pay%20by%20bank%20transfer" class="keywordUrl">pay by bank transfer</a>.
</p>

<p>

</p>

<p>
	I recently quoted a job, the customer accepted the quote, I did the work, invoiced the customer who promptly <a href="https://www.consumeractiongroup.co.uk/announcement/32-are-you-going-to-pay-for-your-second-hand-car-with-a-bank-transfer/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=132&amp;alias=paid%20by%20bank%20transfer" class="keywordUrl">paid by bank transfer</a>.
</p>

<p>

</p>

<p>
	About two weeks later my personal account, my personal savings account, my business current account and a credit card were all frozen by my bank meaning I couldn't trade for 3 days.
</p>

<p>

</p>

<p>
	It turned out that my customer had got a bank statement and failed to recognise the payment to me so rang his bank to get further details of the transaction.
</p>

<p>

</p>

<p>
	His bank called my bank who immediately started a <a href="http://www.cifas.org.uk/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=9&amp;alias=fraud" class="keywordUrl">fraud</a> investigation and froze my accounts.
</p>

<p>

</p>

<p>
	I have banked with the same organisation for over 10 years, I have an impeccable banking history, my credit rating is in the top 10% of the country and I have over £40000.00 in available funds with my bank.
</p>

<p>

</p>

<p>
	I have claimed the sum of £1600 as way of compensation as his represents my loss of earnings whilst the accounts were frozen, these losses are as a result of not being able to buy materials, buy fuel or pay wages.
</p>

<p>

</p>

<p>
	The <a href="http://www.consumeractiongroup.co.uk/forum/bank-charges-finance-industry/234186-financial-ombudsman-comes-under.html#post2594577" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=52&amp;alias=ombudsman" class="keywordUrl">Ombudsman</a>’s position is that the bank have acted reasonably, they have mentioned some very catch-all phrases like "standard banking practice" etc but have given no specific regulations or guidelines that the bank should follow.
</p>

<p>

</p>

<p>
	I feel the decision is unfair for the following reasons:
</p>

<p>

</p>

<p>
	1 The bank failed to consider my excellent and long lived banking history and  my excellent credit rating.
</p>

<p>

</p>

<p>
	2 The amount under investigation was only £280.00 yet my accounts had available funds exceeding £39000.
</p>

<p>

</p>

<p>
	3 There was no direct or documentary evidence of <a href="http://www.cifas.org.uk/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=9&amp;alias=fraud" class="keywordUrl">fraud</a>, the investigation was initiated simply because my customer did not remember a transaction.
</p>

<p>

</p>

<p>
	4 The bank could have granted me access to limited funds during the time the investigation took place but instead chose to leave me without access to any of my money which meant I could not buy fuel, materials, food or any other necessary business or personal purchases.
</p>

<p>

</p>

<p>
	The bank could have resolved the issue on the first day by simply calling me to ask what the transaction in question was for, they could have then called my customer to explain my answer and my customer would have immediately remembered the work I had carried out, instead they carried out an investigation which left me without any money for over three days.
</p>

<p>

</p>

<p>
	I have to ask myself what would happen if I forgot I'd bought some shopping at Tesco, would my bank freeze their accounts for 3 days?
</p>

<p>

</p>

<p>
	What is the group consensus?
</p>

<p>

</p>

<p>
	If you have got this far congratulations and thanks!!
</p>

<p>

</p>

<p>
	Apologies if I have posted in the wrong section.
</p>

<p>
	Should have posted these earlier, but I have been laid up in bed with a bad back.
</p>

<p>
	Anyway here all the documents received from NatWest regarding my CCA.
</p>

<p>

</p>

<p>
	Note what is said at the top. “Received into this office on the 24th March 2009”.
</p>

<p>
	Someone actually signed for it on the 21st March.
</p>

<p>
	Is it my problem that it took 4 days from signing for, to reach the relevant destination of their establishment?
</p>

<p>

</p>

<p>
	Regarding the last scan. When has a <a href="https://nationalconsumerservice.co.uk/keywords/view/37-terms-and-conditions/" data-ipshover="1" data-ipshover-target="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;do=hovercard&amp;id=37&amp;alias=terms%20and%20conditions" data-ipshover-width="400" class="keyword">terms and conditions</a> leaflet from 09/08 (arrowed) had any bearing on my original CCA?
</p>

<p>

</p>

<p>
	I take it from these scans; the above does not represent my original CCA with NatWest.
</p>

<p>
	What would be my next stage in dealings with NatWest? They also escaped with the skin of their teeth in providing these documents within the statutory 14 + 2 days, as I received them on Saturday 4th April.
</p>

<p>

</p>

<p>
	I received one from Lloyds Tsb and Capital one, but will have to post them tomorrow night as photo bucket is not operating right at the moment.
</p>

<p>

</p>

<p>
	As Advised by a fellow GAGGER I have moved this into the NatWest area.

<p>
	Am I being a bit picky with this point?

<p>

<p style="background-color:#ffffff;color:#000000;font-size:14px;">

<p>
	I have banked with NatWest since 2012 for my Business and on 23rd March, they claim to have sent me a letter advising that after Reviewing my account, that they are no longer able to offer us banking services and that my account would be closed in 60 days from the date of the letter.  I never received this letter.

	I am getting a lot of letters from PRA asking for payment/settling my account offering discounts (of about £100).
</p>

<p>

</p>

<p>
	Do I continue payment plan as before? I can't CCA as they are an overdraft I believe

<p>
	Hello Guy's<span>today had a telephone call from a with held number ( ive been awaiting a call from the hospital which is why i answered ) but it wasnt the hospital turned out to be Capquest!.</span>
</p>

<p>

</p>

<p>
	The lady on the phone was talking and i was listening , she proceeded to tell me that they are making contact in regards to an old natwest account they have had since 2006 .<span>she then stated the account is for £386.99 from 1999 </span>
</p>

<p>

</p>

<p>
	<span>at this point i admit i did burst into laughter and asked her to repeat that last bit, she repeated it ! i then simply told her for this alleged debt to put everything in writing</span>
</p>

<p>

</p>

<p>
	<span>said ok and that she will put this account on hold till the 14th feb LOL tho she did say something out the blue in regards to a default notice that there wasnt one .... h mmmmm ok well i didnt make a comment on that but just found it strange .</span>
</p>

<p>

</p>

<p>
	Anyway this debt is 23 years old and i would have been 15/16 years old wayyyyyyyyyyyy back then .
</p>

<p>

</p>

<p>
	so would it be the standard statue barred letter i send ?
</p>

<p>

</p>

<p>
	thanks in adavnce .
</p>
