<p>I wanted to start this thread as a middle ground for 'What made you smile/swear today.'  We have thoughts which don't make us smile or swear but you contemplate on an issue. What concerns you, what worries you, how you would rectify it. There's also the good things that work, you may have new ideas, a space for any thoughts you have on your mind.</p>

My thought today is how large privatised companies can hold the country to ransom, being big and powerful and if there's a problem you will do our bidding. The Banks and energy companies come to mind.</p>

	Had an emergency appointment with my dental practice because of a pain in my gum which I told them seemed to originate from one of my second molars.
</p>

<p>
	After an Xray I was told this wasn't anything to do with the tooth and was probably sinusitis, and given some exercises then charged £27.
</p>

<p>
	My doctor subsequently said it wasn't anything to do with sinusitis and to go back. 
</p>

<p>
	Two weeks later I saw a different person at my dental practice, who took a new Xray and said the real problem was not the second molar but the wisdom tooth next to it, which had the biggest ever hole and needed to be extracted.
</p>

<p>
	When I asked how come the other person didn't twig that, I was told "I'm a dentist, they're just a therapist".
</p>

<p>
	Should I ask for my £27 back? 
</p>

	I fully supported the last Doctors pay strike, but think the latest strike is going too far.  The average pay including overtime and weekend pay rates, appears to be very competitive and when you include employer pension contributions appears to be competitive with overseas employment options. You cannot directly compare with overseas rates, as other countries will factor in local costs of living etc.
</p>

<p>
	NHS Employers currently <a href="https://www.paypal.com/donate/?cmd=_s-xclick&amp;hosted_button_id=CC88U8B6MMCDU&amp;source=url" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=28&amp;alias=contribute" class="keywordUrl">contribute</a> 23.7% of gross pay towards employees pensions.
</p>

<p>
	And many Doctors will progress in their careers and have the potential to earn far more later on.
</p>

<p>
	If the BMA continue to vote for strikes and actually take actions which impact on patients, I could see a Labour Government legislating to ban healthcare professionals from being able to strike.

	They were made through Experian and their pre approved offers with my credit profile.
</p>

	As a sales manager in the motorcycle trade I disagree with some of the recommendations. let me expand.
</p>

<p>
	If a fault arises in the first 30 days of ownership you are entitled to reject the vehicle without the dealership having an opportunity to fix it. If the fault arises after 30 days then the dealer has one opportunity to repair it up to 6 years (<a href="https://www.consumeractiongroup.co.uk/forum/332-the-consumer-rights-act-2015/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=17&amp;alias=consumer%20rights%20act" class="keywordUrl">consumer rights act</a> 2015). The six month date relates to faults, before 6 months it is considered to have been present at point of purchase, after 6 months you need to prove it was. But you also have other rights under durability and fit for purpose.
</p>

<p>
	As you noticed the fault the day you got the bike home I'm assuming you told them quickly and definitely within the 30 days. Just because you didn't ask for immediate rejection doesn't mean you forfeited that right, its about the date of the fault. The clock also stops until its repaired, which it isn't yet. Plus even if you're outside of the 30 days they haven't been able to fix the bike with their one opportunity and within a reasonable time.
</p>

<p>
	I would therefore write to them to tell them that you are rejecting the bike under your consumer rights within CRA2015. If they refuse you can either use the Motor <a href="http://www.consumeractiongroup.co.uk/forum/bank-charges-finance-industry/234186-financial-ombudsman-comes-under.html#post2594577" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=52&amp;alias=ombudsman" class="keywordUrl">Ombudsman</a> to help or go straight to court. Luckily as its under £10k you can use the <a href="https://www.consumeractiongroup.co.uk/topic/337754-small-claims-actions-in-the-county-court-faq-work-in-progress/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=101&amp;alias=small%20claims" class="keywordUrl">small claims</a> court yourself with the costs of a solicitor and without the risk of the court assigning costs to you if you loose. I took Peugeot Finance to court myself and won my case. If you do go the court route make sure you send them a <a href="https://www.consumeractiongroup.co.uk/topic/406231-the-pre-action-protocol-for-debt-claims-is-made-by-the-master-of-the-rolls-as-head-of-civil-justice-1st-oct-2017/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=8&amp;alias=letter%20before%20action" class="keywordUrl">letter before action</a> otherwise you risk it being thrown out of court before starting.

	seems <a href="https://www.consumeractiongroup.co.uk/topic/337754-small-claims-actions-in-the-county-court-faq-work-in-progress/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=101&amp;alias=small%20claims" class="keywordUrl">small claims</a> court is getting more expensive and potentially moving to a more self funded system, especially given that when looking at the MOJ finances for 23, <a href="https://www.consumeractiongroup.co.uk/topic/337754-small-claims-actions-in-the-county-court-faq-work-in-progress/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=101&amp;alias=small%20claims" class="keywordUrl">small claims</a> is far closer to being self funded than any other service (i pressume down to the fact that the <a href="https://www.consumeractiongroup.co.uk/topic/337754-small-claims-actions-in-the-county-court-faq-work-in-progress/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=101&amp;alias=small%20claims" class="keywordUrl">small claims</a> track deals with a lot personal injury claims and RTA claims, which end up with thousands of fees but rarely actually get to court, and when they do require little more time to deal with than a £100 <a href="https://www.consumeractiongroup.co.uk/topic/391121-have-you-received-a-parking-ticket-please-fill-this-out/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=118&amp;alias=parking%20ticket" class="keywordUrl">parking ticket</a> - because I can't think that the <a href="https://www.consumeractiongroup.co.uk/topic/391121-have-you-received-a-parking-ticket-please-fill-this-out/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=118&amp;alias=parking%20ticket" class="keywordUrl">parking ticket</a> claims we see a lot of can be self funding).

	I wonder if this will cause a change in parcel companies and particulary parking claims, because I pressume it will now cost them £50 to issue their £170 speculative charge, as well as I assume another around £35 to get a hearing, and for companies like parcel2go and <a href="https://www.consumeractiongroup.co.uk/topic/451871-the-courier-industry-and-your-lost-or-damaged-property-%E2%80%93-some-general-principles/thing-is-the-same/" rel="external nofollow" target="_blank" data-ipskwclicks="1" data-ipskwclicks-urls="https://nationalconsumerservice.co.uk/index.php?app=keywords&amp;module=keywords&amp;controller=keywords&amp;do=clicks&amp;id=146&amp;alias=evri" class="keywordUrl">evri</a> that are subject to a lot claims, it must cost them a fair bit more if each claim is an extra £15 on top, given how many volume they do.

	I also heard they are expanding their paper determination pilot from next year to mean that allocation judges can determine a case on the papers alone if they dont think a trial will be needed. I wonder how much change this will cause tho because its only legacy claims that have the allocation judge imput, with the new ones using legal advisors. Although I did see that OCMC claims will not have compulsory mediation until at least may 2025 (that was in the impact report) because HMCTS said it faced "challenges" in its integral mediation.

	There was also a part in the mediation update, which I'm not sure if you saw, but it talked about the fact that actually its very hard to issue meanigful sanctions for failing to attend mediation, and it seems people are quite quick up to pick up on this because striking out the whole claim/defence would be not proporital in a large amount of circumstances, and ordering parties to pay costs of the missed appointment was quite hard, especially given that most parties told the mediation service they wouldn't be attending soas to mean the mediation service could offer the appointment to someone else. The mediation integration report also touched on the fact its actauly quite difficult to work out the cost of a missed appointment (i.e if parties agreed but didnt attend, how much that actually costed).

	They also talked about the fact that a lot of companies/parties that did not want to partake in mediation, used the old N180 DQ (which allows you to tick yes/no for mediation) as a pose to the new one, and because the form is still considered valid the report found it hard to enforce the mandatory mediation.

	So overal it seems costs are going up but the new ideas arent quite going in the same direction!
