It seems that the intention behind this delay is to limit the time available for individuals to respond, pressuring them into making payments they may not otherwise owe. I categorically deny any responsibility for, or obligation to pay, the so-called “parking charge” mentioned in your communication.  Your claim is without merit and I do not accept the existence of any debt. The alleged violation you reference is entirely unfounded and lacks credible supporting evidence. I am fully aware of the questionable business practices associated with Southgate Park, Stansted, which have been widely criticized and have attracted the attention of the media, including Channel 4 (link in case you missed it https://www.youtube.com/watch?v=5i_RcNM4SM0 ). It is clear that this site is not focused on legitimate parking management but on trapping unaware drivers into unnecessary charges. The manner in which you are attempting to coerce payment through threats of legal action appears to be nothing more than an unjust and unfounded effort to pressure individuals into paying charges that cannot be enforced. Should you choose to pursue this matter in court, despite the apparent lack of merit, I will be requesting an unreasonable costs order in accordance with CPR 27.14(2)(g). I kindly request that you cease any further contact with me regarding this issue.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

Should I pay? how would I word my initial appeal letter?

 

I recieved a ticket, offence 02 for parking/loading or unloading on a SYL which I think is unfair and do not wish to pay.

First off the ticket was not attached to the vehicle, could have been placed under the window wiper at some point as I know they have to take pics of the ticket and your tax disc, but the ticket has adhesive strips to attach to your windscreen to pervent it blowing off but these were not used as they still had the bit you are supposed to peel off attached.

Is the PCN legally issued if the PCN is just being supported by your wiper, and not actually attached to your car using the sticky strips provided on the back of the PCN? in the hope the wind doesn't blow it away!

 

The single yellow line appears to be broken into 2 separate sections by building works that extend over the pavement and approx 1.5m into the road and on top of the yellow line, if it is still there under all the dust and builders rubble.

 

I parked on the right hand side of the temporary (6 months so far) fenced off construction area. There is no sign stating any restrictions in the place I parked, the sign is on the other side of the construction area, left hand side.

The road turns left approx 3 car lengths behind where my car was parked with the SYL terminating and turning into DYL on the corner, don't know what is round the corner.

 

The construction area is about 3m in length, more if you include the skip I parked behind. So the SYL is not visible due to building works as they are effectively using it as a construction area, I suspect, when the builders eventually finish we will see, it may indeed be 1 complete SYL, but until they do it is quite impossible to tell! and I've been given this ticket!

 

The ticket was recieved outside the main Edinburgh PCZ in coburg st.

The restrictions in place on the small section of SYL at the other end of the construction site states no loading/unloading between 16:30 and 18:30, The ticket was issued at 16:37.

The road is really wide where I parked, approx 1 and half lengths of a double decker bus! the buildings are all residential converted from business premises and I was half way up 5 flights of stairs with a heavy wardrobe at 16:37, and returned to my vehicle at 16:43 where I found the ticket on the ground next to drivers door on the pavement side.

 

Any help advice appreciated, don't know if Davies v Heatley applies or some other rule re: construction works and parking signage or the PCN not issued correctly due to not being attached to vehicle.

My mother was admitted to hospital with serious illness last night so I'm just going to pay it as I can't deal with this right now.

Another consumer shafted.
