Firstly, you have every right to be absolutely fuming at MFG.  You go twice and spend money - and what do you get?  A demand for £100!  Do the people who caused this mess resolve it?  No, they lie and mess you about.  No wonder you're so angry. However ... we're worried you’re leaving yourself open to accusations of theft (even though you made it clear the goods would be returned) and criminal damage.  If you take the initiative and approach the garage politely, (a) that covers yourself at least a bit regarding any possible criminal accusations, and (b) if the manager has a brain you two can easily sort everything out. I say if the manager has a brain.  They might try and play the hard case and stupidly put the blame on you.  Who knows. Anyway, how about sending this 1st class post on Monday?   Dear Manager, I am the person who temporarily took some non-perishable goods from the BP shop on Wednesday and left a letter. I have since calmed down and am writing this letter in a friendly, amicable way between adults without abuse or at all costs apportioning blame. What happened is that some time back I visited your premises at 3.15am to buy fuel.  I then revisited at 8.30pm the same day to use the shop. Afterwards I received an invoice from Euro Car Parks for £100 (discounted to £60 if paid within 14 days). What happened is that the ANPR cameras joined the two visits together and ECP issued the invoice for me staying an absurd 17 hours.  I mean you provide a good service but who would stay 17 hours! If you Google "double dipping" you will see that this is a continual problem in the private parking industry and the industry’s own Code of Practice highlights how steps should be taken to avoid issuing invoices in these cases. When I brought this to MFG's customer services' attention you refused to have the invoice cancelled.  I also visited you and again you were unhelpful. Please "take a step backwards" and put yourself in my position.  Say you visited a supermarket on a Saturday evening.  You also visited on a Sunday evening. Later you got a demand for £100 from a private parking company.  You politely asked the supermarket to intervene but they refused.  I think you would consider the matter unfair and you would be extremely angry with the appalling customer service. Anyone who has even a rough knowledge of the law knows that ECP are your agents, you called them in.  You are the organ grinder.  They are the monkey.  You can easily tell them to cancel this invoice. So i am writing to request an appointment with you in order firstly to return the goods which are yours and of course which I should never have taken.  I would like us to be able to speak in a friendly, adult manner. However, secondly I am not prepared to take all the blame for this matter.  I also request confirmation from you that you have had this unfair invoice cancelled. Yours,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

we had a bailiff turn up whilst i was out in dec for council tax arrears

 

on the first notice it says we owe 606.87

this was left in our letter box

 

my husband phoned and he came round again to set up an arrangement

sorry the figure above includes a £24.50 first visit fee that was 14/12/2009

 

his mate turned up later after my husband called

he let him in the house so you guessed it there is now a levy fee walking in possession fee as well

so amount gone up to 661.87

 

the amount he says i owe the council is £582.37

this morning i have received a letter from council stating charge for year 1/4/2009 to 31/3/2010 £484.79

this is because they have had my husband end of year accounts

 

now we have a agreement set up with Ross and Roberts for 170.63mt

we paid 150.00 in dec

170.63 in jan

next payment due tomorrow for 170.63

 

the council letter today says there is only £143.55 left to pay

i have left a message with ross and roberts

 

what should i do about tomorrows payment not pay as their figures are wrong

they are also expecting a payment in march

 

should i just speak to the council on Monday

i also want to know the laws regarding disabled people

 

i am registered disabled and should he be able to enter my home

if you good people could advice

 

so i have all the facts when i speak to these people

i would suggest that you phone the council in the morning and ask how much the bailiffs have paid to the council from the payments you have made

 

as a rule bailiffs take there fees first before they pay any money to the council

 

I don't think this is the case here from reading your thread your bailiff fees should be £97.50 approximately broken down as

1st visit fee £24.50

2nd visit fee £18

walking possession fee £12

levy fee £43.10 going on the amount he says i owe the council is £582.37

 

 

you have a walking possession agreement with the bailiffs and if you don't pay them tomorrow they will add a van fee to this account and it will increase the debt by £150 approx

i would pay £143.55 direct to the council and ask them for a letter of some sorts to state that you account is clear

 

send a copy to the bailiffs office with a letter to state that your account is now clear and they have no right to enter your property and if they do you will report them to the police By 999 as trespass and harassment as there will no longer be a debt to chase

 

once you have given them the letter keep a copy for you and if you do have to call the police at any time show them for the avoidance of doubt they have then been warned and will be committing a criminal offence.

but they are asking for more then what the actual outstanding debt is

now the council only want 142

they want 170.63

 

i really do not want to pat them tomorrow

i have kept a message on the bailiffs answer phone but they haven't phoned back

i understand what you are saying but your bailiff fees have to be paid and if you don't pay the bailiff the money tomorrow then he will add a van fee

you may only owe the council £142 but you have bailiff fees on top of this

it may be that the council have adjusted your claim again and you have paid the bailiffs fees

it could also be that the bailiff gave you the wrong amount owing to the council

 

you must find out from the council how much of the £320 paid to the bailiffs has been sent to the council if they have sent it all then you will owe the council £142 plus bailiffs fees £97 approx

 

if the bailiff has paid the council £178 then you have paid the bailiffs fees and only owe the council

 

you must find this out if you pay the council tomorrow and you still owe the bailiff they will add a van fee of approx £150

I think I see what the problem is here and will try to explain.

 

The Council obtained a Liability Order for £XXX and with the associated bailiff Charges this has now risen to £YYY for which you have an arrangement to pay £QQQ per month.

 

Now the Council are coming along and telling you there is a change in what you owe and it has dropped to £ZZZ. Unfortunately they have not yet informed the Bailiff who could then adjust any payment accordingly. As far as the Bailiff is concerned you still owe the monthly payment agreed and any failure to do this will result in extra charges as hallowitch has pointed out or they could remove the goods they have listed on your Notice of Seizure.

 

In my view your best course of action is to pay your normal payment when it is due. On Monday contact the Council and ask how much is still outstanding and ask specifically if they have forwarded the new amount to the Bailiff.

 

I would also suggest you post on here what goods the Bailiff has levied on as you never know he may have included something that may make his levy invalid - in which case all associated charges would have to be removed/repaid.

 

If the Bailiff is due to come you could tell him about the letter from the Council but I doubt it will make any difference. When all is sorted out any monies overpaid have to be returned to you but usually this is easier once you have paid as you then have no worries of them returning with more threats.

on the letter from council it says your claim for council tax benefit has been reviewed because of partners self employed accounts as a result of your revised award you have been underpaid the sum of 56.12 which as been calculated as follows from 15th feb to 1/4/10 weekly awards previous 7.34 new 16.07 there is also a new council tax bill for 2009/201o it reads as follows

charge for period 1/4/2009 to31/3/2010 £1309.74

less council tax benefit - 523.82

court costs 40.00

less payments 341.13

 

amount to pay 484.79

 

 

instalment plan date due 11/02/2010 143.55

Unless I've misunderstood what you wrote earlier you gave the impression there was only the £143.55 left to pay, however it appears that this is actually the £484.79 above and the instalment is £143.55 this next time.

 

I think given the short time you may have you have to be guided by what your newest best friend demands and you can argue/balance the payment next time although if you do this get them to confirm in writing.

By all means show him the Council letter - try and record his comments.

 

I also think it may pay you to ask for a statement of your account including a screenshot.

Still looking at how what appears to be 1st visit, 2nd visit & levy were carried out.

You may have posted this wrong if that is what you think as from above you have:

Original CT £1309.74

Court Costs £40.00

Total = £1349.74 - A

 

CT Benefit £523.82

Payments made £341.13

Total = £864.95 -B

 

Outstanding A - B= £484.79

 

If as you say that you only have £143.55 left to pay a quick subtraction of £484.79 - £341.13 would leave £143.66. Either the figures you have given are wrong or your own calculations are, sorry to say but in my mind there is still £484.79 outstanding. As you are in doubt of this you must ring the Council in the morning to ask them. You judgment of what you are reading may be clouded by not totalling up from the beginning.

 

I hope you don't take any offence at what my stance but I can only go on the figures provided.

There are 2 things that may crop up and think you should be ready for them.

 

The first is the amount of your payment as it is less than they may have been expecting, you can counter that by explaining what the Council say you have to pay. Think they would be very hard hearted to penalise you for this as you would have been between the devil and the deep blue sea. However you can prove this with the Council's letter.

 

The second may be the payment date as the Council say 11/2, counter this by telling them you knew letter was coming but didn't arrive until 13/2 & paid at first opportunity.

 

If you have a good payment record you should be OK.

I have paid the higher amount that the bailiffs where asking for

the same as what i paid them in Jan £170.63

 

 will get council to speak to them if there is an overpayment

the date fixed with the bailiffs arrangement is the 14th JAN FEB MAR

 

i have made it today but sometimes it can take a day or so to go through but we shall see what happens tomorrow
