    • Thanks. Maybe you could have a look at my summary – and go through it and confirm my understandings. Also, now that you have evidence recorded I think it would be a good idea to reveal the name of the dealer. I know the name already because you posted up on Facebook – but I think it will be a good idea to post it here. There is no downside. It might attract other people who have had similar experiences and who may be helpful to you and of course it may be helpful to others in a similar situation. We normally find that publishing the name of dealers is helpful because once they realise that their reputation is at risk, though sometimes start to become compliant. Also, if we have the name of the dealer you may be able to make our own research which will help to refine our advice.

I wanted to avoid any confrontation but i feel helpless against these evil  morons, i should not have to fight it and hope the court sees things in my favour, its the whole process that makes me want to kill somebody, i wont but im not always in control of my actions due to my  mental health condition.   All going well i wont hear from the police but who knows, ill just have to wait and see, the morons deserved it but i did not go there to cause agro, i was held in an impossible situation. I have told doctors many times i might end up in jail or kill someone or kill myself.    FTMDave thanks for your reply i will let you guys know if i hear anything.   ------------------------- Today i called Citizens Advice and told them everything including my vulnerabilities, i have a phone appointment on the 22nd to discuss the illegal PCN. Im not sure what they can do but ill see if my vulnerabilities help in any way  
    • Sorry I was just editing because I didn't seee your first reply. My bad sorry and yeah 70% criminology and 30% counselling, just give me more options when I graduate. Victim support etc.. how ironic lol 😆 
    • No particular relevance – but always interested to know what university students are studying. I have known lots of criminology students – but I have never heard of a degree which involves criminology plus counselling. I hope it works well for you. What about the answers to the rest of the questions?
    • Yes im going to university in September studying criminology with counselling, everything you have said is correct. I have the voice recording of me asking him for a breakdown of what the £500 would be, then he offers me the new deal of straight swap on the £200 service cost all recorded. I extended the warranty from 3 month to 12 month on his advice. The company is called handler protect and it was an extra £100. The warranty declined as they said it is due to age and not a sudden failure apparently.  I'm unsure what you mean by a letter of rejection. I have sent a formal letter requesting a replacement or a refund on the advice CAB. That was sent on the 13th June.  And yes i paid for the original diagnostic from another reputable garage.  Hope this helps and thank you 😊

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bank making money from our money

:mad: Something has to be done about the way the banks are keeping hold of our money inbetween transfers and making money out of it .Last sunday 19th March I transfered a small amount of money from my bank account to pay the balance for the same banks Credit Card .Before midnight that night they took the money and it had Mondays date it is now 8 days later and my balance is stll not cleared.ok in this instance it is a very small amount but sometimes it's not and it can't possibly take this long to be automatically transfered from one department to the next.I have put a complaint in and waiting to see the answer but this is a ridiculous amount of time.Also I have noticed that even though it's all done automatically when it comes to the time my statement is being produced it takes even longer .I have phoned up constantly and been told in not so many words that I'm imagining it .

Janet, even for cash onto most credit cards it seems not to be cleared for 6 working days. In relation to transfers for example between you and me there is faster payments just around the corner, as well as clearer advice on the cheque clearing cycle. As I said it is just around the corner. In relation to automation, I do think there is a certain amount of manual reading of credit card info, I hope someone who works within a credit card company can correct me on this or who has had experience of working within the sector can post on here.

I believe the regulators (sorry, not sure which) agree and are looking into making the banks get their collective fingers out over the time it takes for money to be cleared. It is a ridiculous state of affairs, as they can make money from the interest while they have it and we can't touch it.

All the banks have their total funds invested on the international money markets... yes that’s our money they are playing with and why it takes so long for transfers to happen because they have to replace your invested money with someone else’s... call it a perk of the job but it would cost a lot more to use a bank if they didn’t do it...

What I cant accept in this age of electronic wizardry is the clearing times haven’t reduced, minimum 3 days was in the days of cheques ffs…. I can do an internet bank payment and my money disappears instantly, it reappears 3 to 10 days later where I sent it.... yep they need to make money from their business but they are taking the p*ss at the moment..... funny my credit rating alters instantly I wonder if that’s a different computer....

how about 22 days ? I have just been caught by this one -

In March I applied online for a GE Money card with 0% deal, and to transfer the balance from an existing credit card at 0%. My card duly arrived before the end of March and I naively believed the transfer would therefore be processed.

On 3rd April I received the old credit card statement to find the balance hadnt been cleared & I had therefore incurred £23 interest. I rang GE who could not find the transfer instruction from my online app, agreed it was a problem they had and they would make the x/fr immediately. I then spoke to a supervisor who agreed to credit my £23 as goodwill.

My GE statement at the end of April shows the x/fr out of my card on 03 April.

Today my old credit card statement arrived. Lo and behold the credit went on it on 25th Apr - 22 days after being debited from the GE account.

And I have now incurred £12 late fee and £43 interest on the old card so I still owe them £55

When I rang GE they said I was told (in the CCA) it took 15 (working) days to clear balance x/fers so I had no cause to claim.... I was NOT told on the phone it would take this long - otherwise I'd have made a min payment to cover myself.

How can this be so - I expected 3-5 days for the normal "electronic" BACS system but not 3 weeks.

Anyone had similar experiences / advice as to where I should start complaint please??

worth reading the small print on the balance transfer bit IMHO. Sometimes i know it is easy to assume but with a balance transfers, timescale is everything.
