    • I was due to settle on my new house last Friday , with deposit already paid and mortgage in place. However at the last minute the sellers solicitor has confirmed there was a 2nd mortgage taken out on the property by the previous owner. I therefore can't buy the property until they know the debt was paid. the company was Welcome Finance and the debt was sold to Prime Credit 5 Sarl. No one can find contact information for them to confirm that there is no outstanding amount due. Both my and the sellers solicitors are looking into this but coming up blank so far. can anyone help as we are all ready to move and this has completely set us back. All help and advice very much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

...they are obviously getting snowed under with requests for new accounts. Just received two letters regarding my applications, asking me to sign the 'enclosed' forms...only trouble is they forgot to enclose the forms...

 

Maybe they don't want new customers any more.

Updated:

 

One of them asked me to sign a form - the other turned me down after a check with Experian. Therefore, I want to know why, and have requested my credit file, as no-one has ever informed me that a notice against my credit file has been lodged...surely you have a right to be notified...don't you?

Update (from yesterday): rang with a query, and was able to open a Co-Op Cashminder account there and then!

 

If you ring the Co Op on:

0161 947 7135 - they will try to fob you off with an 0845 number. Ask nicely and firmly, and they should put you through (much cheaper...)

 

I asked if I could open the account online, the young lady said I could do it on the 'phone. They clearly have to go through the ten minute spiel (personal details and the like) and make a couple of checks to prevent money laundering. No check against CRA (this is a non-overdraft account) - and the account is accepted.

 

A few days later you will receive the documents in the post (actually, mine turned up this morning!!!), sign, send proof of ID, and the account is yours...

 

Painless, efficient and incredibly convenient. Dare I say "well done Co-Op?"

Maybe your credit file was too good so they scored you low.I have heard of someone being refused as they have had no debt ,paid all their bills on time and owed no money to anyone.Bank thought they where not a good customer as they would make no money from them.A good customerto a bank is someone who goes into debt but pays a small amount back regularly and on time.A customer like that can make them a lot of money.

Guys - I think you missed the point on this: the whole concept of the cashminder account is that they don't do a credit check because you will not be getting any credit facilities...clearly there must be an additional factor in Mr Cheddar's case...

Can anyone help with a bank account for someone who is not on the electoral register, has had adverse credit in the past and is now trying to start all over again. Recently applied for a Nat West step account but was refused even after bringing in passport, utility bill etc...

Natwest are continually calling and trying to move me up from my Step account.

 

They are talking about savings accounts, cheque books and overdrafts.

 

Poor souls, it's only an account in case the Scabbey close my other account.

 

I'll keep them calling, I actually enjoy having a bank chase me for business, fully knowing I'm never going to upgrade the account.
