    • We still have not seen either the Notice to Driver or hte Notice to Keeper PCNs. As these are legal documents that can help  your case could you please post them up. I did ask last year if you didn't retain the NTD that you send UKCPS an sar. Did you do that? If you don't have those two vital PCNs [not the reminders] can you please send off an asr now. Sometimes the rogues use Trace to confirm their address is till valid with a view to sending out a letter of Claim. If you have received the SAR could you please post up its contents.
    • One more thing Madge just make sure that you include the payment confirmation from the phone app to ECP. this will never see Court if anyone at ECP has the ability to read and understand English. Then send it off to court and ECP. Next -at least one bottle of wine between the two of you and relax. It is over..........................
    • Thank you Restart for posting the original PCN-it is the one that has to comply with the Protection of Freedoms Act 2012 Schedule 4. And thanks to Nicky - I hadn't noticed the word Reminder on the first PCN and wondered why it was posted on the 29th June but Restart said he had received it on the 24th. The original PCN is not compliant with the Protection of Freedoms Act Schedule 4 whicch means that you as keeper are therefore not liable for the charge. The driver is the only one now liable and as you haven't appealed they don't know who was driving so you are both in the clear.  It is non compliant because they have not included the actual parking period just their own ANPR times that obviously include driving from the entrance to the parking place and later driving to the exit. Section 9 [2][a] refers- (2)The notice must—(a)specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates; They have also failed to ask the keeper to pay Section9 [2][e]  (e)state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper—(i)to pay the unpaid parking charges Sadly although both of you are in the clear there is nothing yoycan do to bring this to a quick close. So you will just have to read piles of letters containg threats and unlawful increases in the amount they are charging. They can all be safely ignored knowing that your case will be thrown out should it ever get to Court. Though Dave is right that a letter to Starbucks might get you a quick cancellation. All you have to watch out for is a Letter of Claim which if received let us know and we can advise a snotty letter to send back to them. The snottier it is the more likely they will decide not to go to CourtIn the meantime read up other cases which have been successfful or ongoing cases esprcially ones similar to yours to understand the way these vile companies operate. Do not contact them as  you might let slip who was driving and that at the moment is your strongest asset.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok,

 

had a few good replies from this site in the past so here goes.

 

in short, am in debt to the tune of 23k. I have been making payments without issues on everything upto sept 2010. I make the mistake of borrowing from payday load company (swift sterling) to help cover with car repairs, in oct i got hit with massive bills from swift and made the mistake of using another payday loan company to bail out of the problem.

 

ok now (stupid i hear you say, and yes i know) anyway i did it and have to live with it. now i originally approached my bank santander and asked them to help me raise the money by way of extending my loan, they said no, and no to extend od, and to to everything else i had asked for help with. now given i had never missed any payments i was quite annoyed.

 

I raised a complaint with the bank which is still todate being looked at (they keep writing to me saying it will take another 4 weeks to provide an answer)

 

now at this point i started to miss repayments of the full ammounts, i kept up with goodwill payments and i wrote to all my creditors with a full expenditure sheet and explaining the problem caused by using payday loan companies.

 

now since sept i have been continuing like this making token payments to all creditors and continually writing to them keeping them in the loop.

 

i have received every type of default notice you can think of and have reached the point where the majority of creditors have accepted my terms of reduced payments whilst i pay off the payday loan companies. I fully intend to clear down the debts.

 

now whilst receiving the default notices, some of the creditors played ball and accepted, santander have totally ignored me and vanquis moved straight to 1st choice debt collection.

 

for the 1st choice collections i rang them up and said you can have 40% of the debt in full and final or we can go to court up to you as i dont care. they accepted the 40%. (doing well so far)

 

now santander, totally different ball game and the major problem at the moment. I have credit cards (x2) total debt 5.5k combined, santander loan (6k) o/d with santander 2.6k. now santander wrote me a nice letter to tell me that they were going to take money from my current account to service the other accounts.

 

at this point i moved bank accounts to nationwide (basic account) and setup a standing order to repay to each santander account the sum of £10 goodwill whilst we negotiated reduced rates on all account repayments held with them.

 

they have totally ignored all my letters. I have made monthly payments to them and sent them recorded delivery letters fully explaining what was going on and that other creditors had accepted etc. i also included full expenditure each time.

 

i have today received a multitude of letters all on the same day, ranging from default notices to notices saying a representitive will be calling on sunday to see me, through to just plain no we dont accept notices.

 

ok with me so far, everyone i deal with has accepted except santander, i am not sure what else i can do, i keep writing and making the offers to repay both the full debt using reduced repayments.

 

had they of helped me in the first place this would not have happened. so i am stuck on what to do next. Visit a branch and get very loud? write again? wait for the so called visit (should be fun as I'm a big lad and like a challenge).

 

what do you guys suggest i thought i was dong everything correctly, i acknowledged the debts, kept them in touch, included expenditure statements, negotiated payments down to manageable amounts.

 

I'm just stuck with santander??

 

anyone got any advice on what i should do? do they actually call at your house (santader i mean?)

 

i should point out i own nothing and live in rented accommodation, car on finance.

Presumably you are paying all your other creditors prorata. Do the same with Santander whether or not they like it. If ever they did take you to court, a judge would take a very dim view of them not co-operating when all the others have and you've done all you can. Pay pro rata and forget about it.

I rarely disagree with Tingy but I would offer them pro-rata rather than pay pro-rata.

 

Raise a formal complaint with them quoting OFT v MBNA recent decision about accpeting reasonable offers; exhaust their complaints procedure then make a formal complaint to fos: this b*ggers them for many months.

 

Don't worry about door steppers; once you've seen one, they ain't scary.

The reason I suggested paying rather than offering to pay is that if the OC does take it to court you can demonstrate you have been fair and equitable to all your creditors, rather than cutting out one because they're being a pain. What do you think?

The OP doesn't make it clear who has frozen charges & interest and implies that he is paying more than a token amount.

 

Many formal DMPs fail because one or two rogues keep applying charges and interest, which is unfair on other creditors; pro-rata involves equity of treatment as well as equity of payment.

 

I refuse to pay anyone who won't communicate and won't conform to OFT v MBNA re affordable payments; this is a legitimate basis for a fos complaint which I have found useful.

I posted a reply to Vic earlier, but its vanished. Maybe I wrote it but didn't submit it, I guess cos I've disagreed with Vic and have just read her views on war - I daren't move now!

 

What I put, seriously OP, is could you post the info that Vic points out - have they all frozen interest and charges, some, none? She is right that this needs to be taken into consideration (much as I hate to admit it!):-D

total sucess using the OFT vs MBNA thing, first wrote complaint on santander website siting the OFT vs MBNA and the fact i was being ignored whilst trying to make offers.

 

got called two days later (today) bank accepted all my offers.

 

all sorted now , here is an update for you, viking debt collection is 100% santander as i rang them two days ago, and the phone was answered like this. Hello santand....er....viking becky speaking.

 

anyway just to say a big thanks as your advice worked.

 

all good and managable at last.

You can tell the lot you need to pay £1 a month as a token for the next 3 months otherwise it sounds as if bankruptcy might be the best option.

 

Pro-rataing sounds good but when they DO NOT reduce your interest and slap on default sums then £1 is all they should get - or zilch if you prefer and see the offers for reductions come flooding in.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I would only use the phone to wind them up.... but at the end of the day you can use email and set the email to send every hour!
