      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone, i'm new here (this being my first post) and found this forum after doing an online search into Philips.

 

I just wanted to see if Ii could get some advice as to what i can and cant do with Philips and all their threats towards me and should the matter be taken to court where would I stand.

 

Ok the story as it stands now:

 

About a year and a half ago i declared a car off the road and it took me a little longer than I expected actually getting it off the road, subsequentlyIi received a fine from the dlva for the above offence. To my best knowledge I do not remember at all receiving anything from the dvla for a loooooong time after the offence took place. I also had every intention of paying this up, as it was my fault, and only about £135 anyway, but in the mean time I had a bad split with my partner and subsequently moved out and ended up living with my dad (whereIi am living currently).

 

Well turns out my ex was receiving letters from the dvla, and then this debt/ bailiff agency Philips and because I didn't give my forward address and changed my number to my ex she couldn't get hold of me to tell me. After a while she eventually did manage to get in touch and I gave her my address and on a number off occasions we both contacted Philips to change the debt to my address... In the mean time Philips had sent another 2-3 letters to my old address upping the repayment fee about £200 each time.

 

Now I have finally got them delivering to my address and about once ever 3-4 weeks i get another final notice letter first threatening to up the fees, then threatening repossession and now threatening me with arrest.

 

The amount they are now asking for is £661.25. I have tried on many occasions to talk to them over the phone and come to some sort of agreement in regards to a payment plan but all they do is fob me off with "sorry the manager is not here/ the manager doesn't talk to clients". Also no matter how much I protested they was originally insisting that i pay £56 per week to repay the debt (not in the slightest taking in to account my current financial situation). When I couldn't do that they are now on every attempt to make contact they insist I just pay the full amount.

 

I have since given up attempting to come to some sort of arrangement over the phone and have now started to only contact them via email (as they have on a couple of occasions denied that I have called at all). One reason I have decided to do this is I want a written record of all correspondences between me and Philips should it be taken to court.

 

Well there is no change in the situation other than them now threatening to take me to court and have me arrested. Any email they send in reply to mine (where I am openly offering them a payment play) come back saying I have to pay in full and that's that.

 

I mentioned my financial situation above, and that is that I am a single, unemployed student not getting any benefits and basically living off of student loans and my dad... sad i know for a 25 year old but that's how it is...

 

So any help or advice any one can give me will be greatly appreciated as although I am confident i might come out on top should it be taken to court what with my attempts to come to an agreement with them and their refusal, I don't like this just hanging over my head all the time and my current girlfriend who is about to give birth is getting incredibly stressed out over it.

Ignoring a court would most likely result in a warrant for arrest. Fines Offficers and Civilian Enforcement Officers (CEO's) are employed by the Magistrates Court under the provision of s92 of the Access to Justice Act 1999 and the Magistrates Courts (Civilian Enforcement Officers) Rules 1990 and the Courts Act 2003. They are 'bailiffs' who are able to execute a range of warrants including distress warrants and warrants of arrest' date=' and commitment for non-payment of fines and other sums a court had ordered to be paid. In addition, they can enforce warrants of arrest for breaches of community sentences.[/quote']

 

But was this a case that DVLA took to court' date=' or is it one of DVLA's own penalties, that as far as I know cannot result in arrest.[/quote']

 

The DVLA must have taken this one to court' date=' judge ruled in their absence, then non payment of fine. They then issued an arrrest warrant. He should go and hand himself in to a Police staion and get it sorted out. It would be very embarrassing to get the hand cuffs put on in front of the neighbours and family.[/quote']
