    • good evening guys lookinforinfo many thanks for your reply and support. Thanks for getting the team to move the posts to a MSG thread. I wanted to avoid any confrontation but i feel helpless against these evil  morons, i should not have to fight it and hope the court sees things in my favour, its the whole process that makes me want to kill somebody, i wont but im not always in control of my actions due to my  mental health condition.   All going well i wont hear from the police but who knows, ill just have to wait and see, the morons deserved it but i did not go there to cause agro, i was held in an impossible situation. I have told doctors many times i might end up in jail or kill someone or kill myself.    FTMDave thanks for your reply i will let you guys know if i hear anything.   ------------------------- Today i called Citizens Advice and told them everything including my vulnerabilities, i have a phone appointment on the 22nd to discuss the illegal PCN. Im not sure what they can do but ill see if my vulnerabilities help in any way

    • No particular relevance – but always interested to know what university students are studying. I have known lots of criminology students – but I have never heard of a degree which involves criminology plus counselling. I hope it works well for you. What about the answers to the rest of the questions?
    • Yes im going to university in September studying criminology with counselling, everything you have said is correct. I have the voice recording of me asking him for a breakdown of what the £500 would be, then he offers me the new deal of straight swap oth the £200 service cost all recorded. I extended the warranty from 3 month to 12 month on his advice. The company is called handler protect and it was an extra £100. The warranty declined as they said it is due to age and not a sudden failure apparently.  Im unsure what you mean by a letter of rejection. I have sent a formal letter requesting a replacement or a refund on the advice CAB. That was sent on the 13th June.  And yes i paid for the original diagnostic from another reputable garage.  Hope this helps and thank you 😊

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

This is my first post and I wanted to say hi to everyone. Like most others I'm rather overwhelmed by all of this and will be spending my weekend reading all the posts and FAQs, having done some initial reading.

 

I used to work for Barclays 20 years ago :o. My current and loan accounts were moved into default last spring due to a WFTC overpayments fiasco (that's another story), so I now have a basic account elsewhere. I've got all my statements for the past 6 years and reckon the total charges will be four figures.

It's taken me 6 months but have finally got round to sending off preliminary approach for repayment letter on 10.04.07 (have statements going back 20 years like the good ex-employee I am :| so no need for SAR). Heartened to read of successes against Barclays. Good luck one and all.

Hi all

 

Received standard response from Barclays on 18.04.07 stating they're looking into my claim but not making any offer as yet (prelim letter sent 10.04.07). Could someone pls advise if I still need to wait 14 days before sending off my LBA, or can I send in response to the prelim?

Lulubelle - you should stick to your timetable - send the LBA 14 days after the prelim, regardless of how long Barclays have told you they will take to "consider" your claim.

Thanks Chorlton. The 14 days has slightly slipped though; am just sorting the LBA now.

 

Can anyone pls give me a definitive answer re adding interest though? I have read other posts, FAQs & the library but I'm even more confused about it (especially as lots of people haven't always done it right, it seems!).

 

I understand I don't add the 8% until it comes to the Mycol thingy (however it's spelt) but am confused about adding daily interest. Do I need to do it, and if so how? Or do I just send the original spreadsheet with no interest just charges?

 

Would really appreciate some help :sad: .

Interest is a moveable feast, and there is no definitive answer BUT in every claim I have every made (and every claim that I have had settled with the exception of my very first one with Amex) I included interest.

 

I have never used the 8% MCOL statutory interest - for my credit cards I always charged them the current interest rate on the card, and for the banks I charged them the prevailing overdraft rate at the time I made the claim.

 

I kept the spreadsheets interest free for the prelim, showed interest on the LBA then claimed for interest at MCOL stage.

 

Easiest way to do it is use the standard spreadsheet then add another column (or change the formula) to divide Vampiresses calculated interest by 8 then multiply the result by the rate you want to apply (then change the heading accordingly.

 

Barclays did not question my application of their overdraft rate (although I did spell it out in the LBA and claim)

I looked at the spreadsheets and have used the advanced one in the end. But I'm not sure the final column (interest on penalties) is right. It's just using the interest charged figure from column H. I think I'm doing something wrong.

 

I had a £3000 O/D facility: up to £1600 was free, £1600-£3000 was 1% above base & over £3000 was unauthorised rate of 24.582%. So in column J I'm entering £1600.

 

Is this wrong?! :confused:

- Have received offer of 50% of claim, £850, following LBA (but after the 14 days)

- In addition to being a full and final offer, it stated the following condition: as there is a debt on my account of almost £2500 (and in fact has been registered as defaulted for 2 years, which was because of not receiving tax credits payments due to an overpayments recovery error) 'this sum to be used to reduce your debt. This is with the cost and inconvenience inherent in a further dispute in mind and is intended as a gesture of goodwill'.

 

I intend to reply with letter 2 (? hope this is right), accepting as part settlement but not accepting the conditions.

 

So, my questions:

 

i- Am entitled to not pay court fees, so completing N1. Having problems with 8% part of spreadsheet, keep getting this error thingy: #Value!

Can anyone please tell me what I'm doing wrong?!:(

 

ii- I don't want to agree to the conditions (I have rent arrears and need to prioritise any money received to repay these), does this appropriation thingy apply in this circumstance? Can I request a cheque in payment?

 

iii- why can't i figure out how to create a new post? Instead I keep on replying to my previous posts. What has happened to my brain?

 

iv- Has the large gin I poured myself earlier affected my coherence?

its your claim you can ask for it to be paid how it best suits you

Re the speadsheets: I have a horrible feeling I did something wrong when I intially entered the data, which mucked up the 8% page.

 

I have tried to download the advanced version again and copy the data in, but the interest amount comes out slightly different and the 8% page still doesn't automatically calculate. (I tell a lie, it did calculate earlier but the interest came out at £27,000ish! Oops! :-| )

 

If you can let me know the calculation I can do it manually and enter it myself? Other, simpler suggestions are definitely appreciated.

Hi all

 

I've had a re-think and have decided to accept the 50% offer I've recieved but I'm still going to reject the terms. I can't find a letter or post that covers it so could someone please help with the wording? (I was going to paste it in but think it may not be allowed as it's taken from a library template?)

 

Anyway I'm saying:

 

- I accept the full and final offer

- But I don't accept the conditions of payment

- I state my conditions i.e. payment by cheque payable to me

- I reiterate I don't accept their conditions

- I give a 10 day deadline for receipt of payment

- After which point I state I will commence court action for the full claim, plus interest plus costs

 

Is this OK? Will it weaken my case if I go to court that I have accepted the offer, but not the terms and then claim for the full amount?

Hi, is anyone able to help with my previous question please?

 

I'd like to accept Barclays offer but not the condition (that payment is used to reduce debt). Could anyone please clarify what happens if they don't respond in time and accept my condition (payment by cheque)? i.e. I'll have to carry on to court, but would I claim for the accepted amount or continue with the whole claim?

If you send them an offer subject to your own conditions, the ball is back in their court.

 

If I were you, I'd be holding out for the full settlement; you'll get it in the end, and I suspect you could do a lot with another £850...

 

but then, I'm not in your shoes.

Do you mean you accept their offer as part payment but will continue court action for the remainder? I believe they usually go on to withdraw this offer if so - I may be wrong on this one though...

Thanks one of a kind. I know; it's a tricky decision and you're right, the extra £850 would go a long way.

 

I changed my mind when I started reading all the posts and stuff about preparing for court and got anxious that this is all way over my head.

 

But maybe I should reconsider??:?

At the end of the day, it's YOUR decision, and no-one on here can make that for you. I thought about accepting the offer they sent me, but decided, after much consultation with OH, to go for the full amount.

 

They're calling this offer a 'gesture of goodwill'. But they only want to pay you HALF of YOUR MONEY. Where's the goodwill in that?
