      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I need a Terracotta chimney pot, preferably Victorian no less than 900mm high and 150mm diameter with rolled top rather than fancy.

 

I have to get it by Tuesday for a fitting on Wednesday 8th May

 

I live in SE London and will pick up.

 

Anyone got one and can pop a photo up I'd be grateful. Re claim places locally haven't got one and I'd prefer an old one for my old building.

 

Anyone? Bit of a long shot, but hey ho!

We had ours removed when we redid the heating throughout the house.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

To use as a proper chimney. We have one which was above a bedroom which we have turned into a 'snug'. We are putting in a log burner having chucked out the old gas fire and naff surround which uncovered a lovely old Victorian arched fire place.

 

In order to meet regulations we need to have 4 mtrs between the top of the new log burner to the top of the chimney pot and we were about a meter and a half short with the old one so the Chimney people have raised the chimney itself by using the old bricks from the fireplace we removed, but we now need another 900mm from the pot to sit on top. My pot is just too small.

 

It needs to be able to accommodate a guard on the top so it really needs to be a rolled top one (Like a sock rolled down the leg with a lip LOL ) rather than one of those with fancy shapes on the top. I'd also like it in Terracotta rather than clay.

 

Does that help? - and thanks for the links, I'm searching hard....not easy to find though with the right dimensions either height (900mm) or diameter (150-180mm).

Thanks folks for all your help, just arrived back from the depths of nowhere with my Pot in toe nearly 200 years old and been sitting in a garden supporting pretty flowers for last 7 years - £25 quid - ebay ! :lol:

 

Now it's going back to respectability and being a chimney pot again and will be in-situ around lunchtime tomorrow.....Like any self respecting smoker I heard it whining in the back of the car " I'm dying for a smoke"

It was a bargain Caro, new one was about £75 - £80, but old ones go from £80 - £125 with the odd rogue one going for a song if you're quick.

 

Daft thing was, I only spotted this on Monday night on ebay and it had a few people watching it - @ £25 it was a sinch and there was just 1 day and 6 hrs left on auction. I waited until yesterday morning to check out the dimensions as they''d only shown the height then rang my chimney/stove installer showing him a picture and he confirmed it as okay. So rather than wait I pressed the 'buy it now' button and it was mine:whoo:

 

Just had to go to within 10 miles of Hastings to get it! - Still, we went for a quick walk along the front before coming home, chilly, but pleasant enough before hacking the road home.

 

All in all - a good day so thank you all - mission accomplished. More than I can say about some of my other recent exploits!! but hey ho-onwards and upwards!
