    • good evening guys lookinforinfo many thanks for your reply and support. Thanks for getting the team to move the posts to a MSG thread. I wanted to avoid any confrontation but i feel helpless against these evil  morons, i should not have to fight it and hope the court sees things in my favour, its the whole process that makes me want to kill somebody, i wont but im not always in control of my actions due to my  mental health condition.   All going well i wont hear from the police but who knows, ill just have to wait and see, the morons deserved it but i did not go there to cause agro, i was held in an impossible situation. I have told doctors many times i might end up in jail or kill someone or kill myself.    FTMDave thanks for your reply i will let you guys know if i hear anything.   ------------------------- Today i called Citizens Advice and told them everything including my vulnerabilities, i have a phone appointment on the 22nd to discuss the illegal PCN. Im not sure what they can do but ill see if my vulnerabilities help in any way

    • No particular relevance – but always interested to know what university students are studying. I have known lots of criminology students – but I have never heard of a degree which involves criminology plus counselling. I hope it works well for you. What about the answers to the rest of the questions?
    • Yes im going to university in September studying criminology with counselling, everything you have said is correct. I have the voice recording of me asking him for a breakdown of what the £500 would be, then he offers me the new deal of straight swap oth the £200 service cost all recorded. I extended the warranty from 3 month to 12 month on his advice. The company is called handler protect and it was an extra £100. The warranty declined as they said it is due to age and not a sudden failure apparently.  Im unsure what you mean by a letter of rejection. I have sent a formal letter requesting a replacement or a refund on the advice CAB. That was sent on the 13th June.  And yes i paid for the original diagnostic from another reputable garage.  Hope this helps and thank you 😊

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi hopefully someone can help me, and hopefully this is the right place for this.

 

Many years ago I defaulted on a HSBC credit card and with discussions between HSBC and myself the payments I could afford they wouldn't agree to so the sent it to Moorcroft I believe, which was fine I explained my situation about being self employed and not having a set amount I can pay each week so they sent a man round to collect each fortnight whatever I had which suited me fine and I was happy with that, over time I had paid a bit off and all was fine HSBC (who I bank with) were happy as they kept a monitor on it. Then the collector stopped turning up and at the time I should have chased it but I was just starting a Partnership business and things were hectic and to be fair I forgot about it until this weekend when a CCJ filed by MKDP LLP turned up.

 

Should I have been made aware that that the collections were stopping with Moorcroft? Should HSBC or MKDP have told me where the debt now lies?

I have a copy of my Experian Report from March 2013 and none of this is on there, I now don't want to end up with a CCJ on there for the next 6 years, I am finally getting myself on track and building my credit score back up.

 

any advice greatly appreciated, thanks

Have you acknowledged service ...what is the date of issue?

 

Can you type out the particulars of claim verbatim less any identifiable data and round the figures up.

"The claimant claims the sum of 4k due from the defendant to the claimant under a regulated agreement originally between the defendant and HSBC Bank plc. The defendants account number was xxxxxxxxxxxxxx and was assigned to the claimant on 29/01/2013, notice of this has been provided to the defendant. The defendant has failed to make payments in accordance with the terms of the agreement and a default notice has been served pursuant to the Consumer Credit Act 1974. The claimant claims the sum of 4K + costs. The claimant has complied, as far as is necessary, with the pre-action conduct practice direction."

 

Should I contact MKDP before I respond to the court? Thanks

What date was your last payment to the account?

 

You must acknowledge receipt of the claim by the 25th Jan..if it is your intention to defend then you will have a further 14 days to submit a defence.

Not sure of when it defaulted but over 6 years now as its gone from my credit report, the card was given to me by HSBC when I turned 18, i'm 30 now. Last payment to Moorcroft was probably a cash payment around 2 - 2 1/2 years ago?

I was trying to establish if the debt is statute barred (no payment or acknowledgment for a period of 6 years)

You really need to confirm the default date to confirm this...if it was pre 2006 ish then it may well be SB

I'm happy to make payments and the cash payments I was making suited me then the guy stopped turning up, I should have chased it but things just got carried away. But I have never been told that the debt had been sold to MKDP?

Thats what Im thinking.....thats why you never pay a DCA as they are unaccountable for payments and I very much doubt HSBC ever saw a penny of your £40 payments.
