    • I have already posted this on another forum but posting it here for more reach,  been told to get proper legal advice which i think i might have to do, About 2 weeks ago i recently completed on the purchase of a house in a small town and moved all my stuff in.  After being away for a few days clearing out my old flat i come back to find the post man knocking at my door with what i can only describe as a small stack of post . In it was over 400 letters all with different names on.  Some peoples name and some company names.   I put them to one side having started a new job, over the next few days i come home to literally hundreds more  Over 2 weeks i have several thousand letters and feel  very overwhelmed I manage to speak to the postman and ask him what is going on and he says he has been delivering this volume of mail for the last 18 months  So i open quite a large number of them and they are from companies like Excel Parking Ltd, Parking Eye Ltd Smart Parking Ltd.  There are also parking tickets from different councils and speeding tickets.  I have also seem some log books from the dvla and letters from debt collectors I contact my solicitor who i brought the house through and the estate agent to get hold of the person who sold me the house and they have asked the couple to get in contact as I have no forwarding address or phone number.  They said when they were selling it that they were moving abroad (i dont know where) I have literally no idea what to do now and literally piles and piles of mail  To top it of i had a bailiff turn up today looking for some one but said he had been here before  My friends say it must be a scam and someone said it sounds like a mailbox address which i dont really understand What can I do ??  help!!!!!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

CCA No respsone - where next?

On the 6th October I sent of CCA request to my credit card company and as yet have had no response. They backed the cheque on the 13th October so I know that they definately got it.

 

By my calculations, they've had the 2 days allowed for postage, 12 working days, and the calendar month will be up this weekend (26th Nov).

 

Having read through the threads, I'm unsure what the next step would be (providing that nothing arrives this week). Can a credit card debt be totally unenforceable? or are they just not allowed to charge me interest on the amount "borrowed" anymore.

 

Any advice greatly appreciated, thanks :)

hmmm, so tomorrow is there last day to provide the agreements. Any suggestions as what to do next anyone?

 

As this topic is still very much in debate, I'm mindful that I have borrowed the money and should pay it back, therefore I don't really want to send them the template letter saying that I don't acknowledge the debt.

 

However, if they wrote off all the interest they'd ever charged me, I'm sure that'd just about clear my balance OR would they just not be liable to charge interest forthwith, in which case I'll continue making repayments and my balance will fall much quicker.

 

Or should I just say nothing to them and report them to Trading Standards and let them sort it?

Does anyone have any further thoughts on this please or details of who to contact.

 

It's time up now and I've heard nothing from my credit card company.

 

I phoned what I thought was trading standards today & the phone number put me through the the OFT in Cornwall. The up shot of it was, they didn't want to know, said I have to complain to my bank and then if still nothing report them to the ombudsman.

 

Surely this seems to make a mockery of the Consumer Credit Act, as I'd be giving them additional opportunity outside of the deadsline imposed in there for them to comply?

I'll continue making repayments and my balance will fall much quicker.

 

I wont be doing anything with mine, i worry if i continue to pay i enforce more thier rights to collect and bring an established payment scheme after teh reguest for the CCA once you send a CCA the ball is firmly in thier court.

 

I feel slightly the same way you do on 1 of my loans but not the other they knew i was in no position to pay them back when they refinanced me, all the money they did lend went back in thier tills, and raised the %the 1 I want to clear i used for a holiday so i feel i did walk away with cash. But I wont pay if it jepordises my status atall.

 

let them sort it out, they always seem to know it all.. when it comes to your money;) :)

give them a couple more days just to cover all eventualities, then write to them stating that they have defaulted on the cca request and as such the debt is unenforceabe (see s77-78 of the Act) and may have committed an offence by not compying in the time scale. remind them of date they received request and that they cashed cheque. they may yet come up with the agreement but they now need a court order to enforce it and it has to have 2 signatures on it yours and theirs. if they don't then they can't enforce it and as breadline stses i wouldn't make any more paymenst as it could be read that you accept this default
