Sent 1st letter two weeks ago and got reply saying can we have £10 pleassssssssse to send you statements/details of charges last 6 years blah blah was all very officail and sent back to in SAE to what seemed to be a special dept (they must be flooded with such requests thanks to this site! Ha Ha)

 

Replied saying take £10 from my account (tempted to say "you know how")

That was a week ago so they have 33 days left to send all the bumph.My online statements only went back 4 years and that came to £1000 so looking at about £1500 me thinks.

 

I see Lloyds TSB like to go to the death by reading the stories here. How long on average have people waited to get justice?

Seems to be around 8-10 weeks with Lloyds unfortunately, powertrip. Still, we'll get the buggers in the end!!! :D

If you have 4 years worth of statements already from online, might I suggest commencing action immediately rather than waiting for the remaining 2 years of statements. There is nothing to stop you initiating the Prelim letter requesting refund of £1000 based upon your calculation - it will only receive the standard response, you can the send the LBA again stating that amount (or an ammended amount in light of receiving your data). You may ammend your claim amount right up until you file, indeed after if you are willing to pay £35 to change the amount for which you have filed.

 

Either way, it ensures you get the ball rolling, and their admin does not delay your action - the result of which will be the same in the end.

 

You can choose to mention in your prelim letter that you are awaiting the full disclosure and will contact them regarding any outstanding balance or you can just leave them in the dark until you receive your full statements. it's a win win as they say...:)

I had letter in response to my request to see all the charges requesting £10 fee to do so. I had to confirm in writing that they could have fee and deduct from account and I did so three weeks ago. They still havent deducted and i notice on thier letter that they have 40 days from receipt of fee to provide info.

Crafty eh!!They are delaying on deducting fee so I have sent stroppy email and rang them DEMANDING that they deduct fee TODAY!!

Watch for this!!

Hi

 

I sent my LBA to Lloyds Tsb on 24th July and thier time is up on Monday.They have been very prompt and polite to date....What do I do then? Do I start a Moneyclaim? Can somebody explain?

 

I am claiming £1612.50 plus £ 370.21 interest. I have been all fired up but now its getting to crunch time I am a bit nervous. How much is it to do Moneyclaim and can I do it on line? Do I need a solicitor?

1) Yes you file moneyclaim - they won't give you your money back otherwise.

2) Yes you can do it online - http://www.moneyclaim.gov.uk

3) It will cost you £120. If you are in receipt of certain benefits you may be exempt - you will have to file in your local court with proof of entitlement if this is the case.

4) No you won't need a solicitor.

I have been trying to fill an online Moneyclaim form for about 2 hours and am STUCK

 

(Its been a bad day,long day in office,toddler tantrums and I cleaned house like mad woman only for potential buyer not to turn up)

 

The bit that says

and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00) Whats the amount? I have worked out the individual interest rates based from the dates charged to the date of claim.Is there an additional amount to be added?

Hello... you're breaking up.. can't hear you!!

 

 

Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount of charges claimed x 0.00022).

Hi

 

What is the Total of the Claim

 

Total Charges + Interest = ???

 

Put that amount on the speadsheet (Amount Column)

and

put yesterdays date (in the Date Column),

 

you should then show 1 day in the days since offence (if it shows 2 days, Change the date to todays date)(I have had that for some strange reason)

 

The amount that comes up in the 8% column is the DAILY Rate

 

Use a blank spreadsheet, to avoid messing up your Calculations

Hi, if you use the template spreadsheet, and put all the data into it as it instructs it will calculate the intrest at 8% for you, just open it on the day you submit and apply the figure to your claim, if you look in this forum for a moneyclaim post which I had some queries you can see how I filled my claim in.

 

I think the bit that's confuses people is that you are telling them this I how much intrest they will pay the on the date you submit but when it goes to court they will be liable for what is calculated on the day by the judge in the future, who will use the 8% figure exactlty the same as the speadsheet calculates.

So that is how I got 39pence

For example, Your Total interest upto 1st July 2006 is £300

 

You are not claiming from the 1st July for the additional Interest.

 

It stays at £300, even thou calculation has stopped on the 1st July ???

Which is why you have the daily interest rate to carry it on. The daily rate of interest is a continuation of the amount of interest you are claiming, rather than something additional to add on top of the interest if that makes sense.

 

When you work out the 8% on the charges, that is worked out on charges alone. The daily rate of interest is basically a different way of working out the 8% interest - on the charges alone. You do not charge the 8% on the 8%.
