      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If the Greens had been given the media attention that reform got - they would undoubtedly have won at least 3 more seats - probably a LOT more  - double or far more that of faragit kippers (whatever they might call themselves this month)

 

If the libdems had received the same amount of media coverage as redeform then they would undoubtedly have won far more than the almost 20 times the number of seats that redeform won eh?

 

If there had been a higher turnout - as i was mistakenly expecting - then the redeform vote would almost certainly have stayed around the same 4M number (commented on this when they were kippers @ around the same - with undoubtedly the vast majority of those lost extra votes elsewhere

- but with starmer being uninspiring, and alienating a number of labour core voters - thats life - and despite that - labor and libdem landslides.

 

Highlight:  libdems circa 20x the repoops 👍

 

Will be interesting to see who jumps where between repoop and torypoop party(s) - without a voter mandate  eh?

He managed to retain his seat (despite his abysmal efforts?) - and promised he wasn't going anywhere - awkward

 

Mind you, if he runs his constituency from california, his constituents would still see more of him and get better representation than clacton will from farage eh?

Farage was on the fisheries committee when he was an MEP. Out of 42 meetings, he attended just one.

Once there's money to be made during the latter stages of the US election, I imagine he'll be off there, never mind Clacton.

he also had the lowest vote record as an MEP didn't he - and a number of even the few he voted in were votes against protections from putins propaganda and interference - unsurprising given the beliefs that farage and his ilk were the beneficiaries of chunks of that russian interference ..

Well, you might get an extra win @theoldrouge as its proving impossible to make an anonymous donation.

 

Using the paypal anon option is rejected as paypal says the site 'requires my address for its records'

Trying to use a credit/debit card from the donate page requires everything to be input - name, address, email, phone number, as well as all the card info, and further progress is rejected if it isnt entered - so seems certain that pre-loaded cards will also be rejected unless that info is given - there appears to be no differentiation on card type

- and false info will likely negate the transaction anyway once validated - losing the donation which might not be able to be returned due to the fake identifying info.

 

I suppose I could offer to donate the money to reform instead - as despite them being REQUIRED BY LAW to confirm donor details - they dont. see below .... But I'm not so bothered about staying that I like that option at all.

- I've spent some hours today trying - and the results have just made me less likely to ever consider donating to a site that sets up donations that way.. Some may be paypal issues - but that 'the site requires your address etc for its records blocking the only option that should guarantee anonymity is blocked ... and with all card (even pre loaded cards) all personal info is demanded ...

Just a little note:

How will the tories move to the center right - which centrist area starmer now firmly occupies,

or lurch any further to the right - which reform sits on and millions of centrist tories have clearly rejected

 

the populist tories are now caught between a farage crock and a hard place. If they target getting reform voters 'back - seems to me they will struggle to do that AND lose at least as many center-right votes as they gain far right.

If he stands for election, I think it will be James Cleverly.  Priti Patel will stand, loose and become Shadow Home Secretary. 

Braverman will stand, loose and jump ship to join up with Reform.

medium term: Merge between reform and Conpoops?

Potentially gets them 4M votes at a cost of prob 1M - which 1M might actually be more than covered by a number of the Con 'not voting for these corrupt **** but who would Never vote labor with them voting tory again, but would also threaten to boost the libdem vote noticeably even more with the more centrist tories

Thing to consider is labor is sitting on a number of policies that the tories promised but failed to deliver because of important 'conservative nimby's - planning rules for starters.

TY for that @theoldrouge - but not honoring even the spirit of my word let alone the detail; for whatever reason;  isn't really an option for me.

I've tried a number of different ways and all require details above and beyond - At least some of those details apparently defined as required  by this site seemingly to negate paypal privacy options. Shoddy for privacy whether the site is bothered about donations or not - and a hell of a surprise.

My last resort is creating a paypal business account with 'suitable info - and using the nickname feature - but I've started and paused that option as part way through I realised I'm not sure I'm prepared to do that and risk my papal account of decades through some as yet unknown issue - and just to try to work around poor privacy considerations.
