      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

my wife has today been accused of shoplifting a few weeks ago at John Lewis.

Police called today and said an allegation has been made after viewing cctv.

My wife has been invited in for interview to clear things up (their words)

I asked her how they knew how to find her, she admitted she had been caught before in Waitrose in 2018 and banned from them and JL.

I can’t begin to tell you how shocked I am but I need to support her and don’t know where to turn.

She has confessed to me that she has stolen the odd thing over the past year from JL and is now worried that they will look back and charge her for stealing all the items.

The police say the allegation is for two small items of clothing.

My wife of 40yrs  I know like the back of my hand has been through hell and has lost all her family over the past few years, she has serious health issues and is on strong medication.

I can only put this down to this being a big factor.

I really need to know what to do to help her, if she admits,  will it be dealt with on the spot or will courts be involved.

Should she seek immediate legal advice or see the solicitor at the police station(that’s what they have offered)

Any advice would be greatly appreciated,

i can tell you 1000% it is nothing to do with anything related to 2018.

and i can also tell you police will do nothing but help

they wont tot up this and that , not interested .

she wont get charged 

she wont come out any worse.

simply be honest on every question they ask.

they are not one little bit remotely interested in making her life any worse and they  will not 

she does not need any legal advice 

just be honest.

can we hope she will receive a fixed penalty and the matter as far as the police are concerned closed.

I know she should not have done what she has done, but now she is in bits and full of regrets and remorse, begging me not to let our children find out, not going to let that happen.

Regarding the interview I’d like her to have some idea what to expect as I’m sure I won’t be allowed in on it.

Will they ask her what and why she did it, if she admits it deal with it on the spot like I said above.

She is also fretting over police randomly raiding our home when the kids are present, I tried to reassure her by saying they would have done that first if they were going to do that.

I need to calm her down, the stress is not welcome, you have helped on that part and I appreciate you responding.

I’m recovering from a mini stroke (tia)  not looking for excuse’s it’s just the way it is.

One thing after another.

Hope it’s over be the end of the week.

Hi Desamax.

We usually suggest that people have a chat with their GP in case there are underlying reasons for the shoplifting. With your wife it sounds as if she's been through the mill and I'm sure the GP will be sympathetic. Maybe they'll be able to get her some extra support.

Hi

sorry for delay in responding.

It went as you said it would, the outcome is yet to be decided, it’s going to be either a ‘community resolution order’ or a ‘caution’ she will find out in the next few days.

They were very kind and understanding and are going to recommend the CRO to their superiors.

She should have been contacted by yesterday but is still waiting.
Thanks again for the fantastic guidance it was very much appreciated.

Sorry for the delay I have had serious health issues,

just to update

my wife was offered an online course

it was a box tick exercise that took about an hour.

No further action was needed, she never heard anything from JL.
