    • Hi All   Just realised leetter dated 13th was thinking it was 24th or there abouts when i got letter this is my draft  ------------------------------ Dear Sir/Madam, I am writing in response to the Letter of Claim that I received from your office on 24th June 2025, which is dated 13th June 2025. It seems that the intention behind this delay is to limit the time available for individuals to respond, pressuring them into making payments they may not otherwise owe. I categorically deny any responsibility for, or obligation to pay, the so-called “parking charge” mentioned in your communication.  Your claim is without merit and I do not accept the existence of any debt. The alleged violation you reference is entirely unfounded and lacks credible supporting evidence. I am fully aware of the questionable business practices associated with Southgate Park, Stansted, which have been widely criticized and have attracted the attention of the media, including Channel 4 (link in case you missed it https://www.youtube.com/watch?v=5i_RcNM4SM0 ). It is clear that this site is not focused on legitimate parking management but on trapping unaware drivers into unnecessary charges. The manner in which you are attempting to coerce payment through threats of legal action appears to be nothing more than an unjust and unfounded effort to pressure individuals into paying charges that cannot be enforced. Should you choose to pursue this matter in court, despite the apparent lack of merit, I will be requesting an unreasonable costs order in accordance with CPR 27.14(2)(g). I kindly request that you cease any further contact with me regarding this issue.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My acknowledement took a few days and then the statements arrived, nicely bound, a couple of weeks later. I guess they're getting busier now as more people realise they can claim back what is rightfully theirs.

 

Sit tight and they should turn up. Then just follow the advice on this site and you WILL win

Oh it will chunky!!!!

I was lucky i had all my statements and they have charged me 310.00 of penalties to my account, wrote to them 12th Dec asking for it back, got letter from them 28th Dec saying no way, we are open and transparent about our charges and if you dont like it, go bank elsewhere........oh i will once my student loan has gone in on 22nd jan, and then we shall see how open and transparent about their charges they are in court!!!!

hi chunky, from what i have understood you should claim one at a time as they can accuse you of wasting the courts time as your claims should be together and therefore not suitable for small calims, as i have read you should split by date and you dont have to wait the remainder of the forty days you can go ahead and send off your prelim.

Hi Chunky1977!

Got my statements through the post this morning. Have checked and am now ready to send pre-lim letter out.Don't forget to also Claim Contractual Interest @ this stage.

 

As my claim is £5k+ do I need to send 2 pre lim letters one for £5k and another for the remainder.Why not go for ONE Claim via the Fast Track Court?...similar to the Small Claims Court, but U just have to fork out a tad more up front, which U will be able to Claim back when U win. NOT strictly true Garu...

I think U meant to say that U haven't had to physically appear in Court (...as of yet hopefully!) before they have started to pay some of your Claim.

The fact that U have Filed your Claim @ Court means just what it says: U have got to COURT!

Many thanks Milk Tray Man. Worked out the Contractual and to be honest for the amount of times I went overdrawn it was minimal (less than £10) so not really worth claiming for.

 

Only 4 minutes till the papers officially get served (well according to MCOLs 10am check)

If U had lost your job and were Claiming certain benefits, progressing your Bank Charges Claim via N1 Form would have been more economical up front for U, with the exemptions from fees etc etc.

Oh shoot!!!!!!!!!!!

I've made a bit of a boo boo and am not sure what to do about it. I've just realised that when filling in my MCOL i put in the notes that I would be claiming the statutory 8% interest, but I then forgot to include it in my total claim:( (to be honest I thought as it was statutory it was added on automatically by the court (its was only after finding the details of where to send my charges that I realised I should've added it on))

 

When I send my charges off today shall I put it in that or have I lost out on it. Its only a couple of hundered pounds so not too much of a drama but I'm just hoping that it won't look bad on my claim.

Not to worry Chunky. Depending on how much the interest is and whether it is worth it, you could amend your claim using:

 

Form N244 - application notice

 

The downside is there is a fee for it, although I'm not sure how much or whether you can (cheekily) add it on to your claim. Possibly not with the latter. I'm sure someone else who is in the know will be able to tell you.

28 days from date papers served (20t May) is up on 17th June.

Thought I would just have alittle look on my internet banking to see if any payments had been made as yet (I know its early but you just never can tell with NW). Anyway it appears that my internet banking have been taken off me. Can anyone explain why this may have happened.
